A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK
SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO IMPLEMENT A
COMPENSATION PACKAGE PROGRAM, PROVIDING FUNDING FOR BUSINESSES
ADVERSELY AFFECTED BY PROLONGED LARGE SCALE FLORIDA DEPARTMENT
OF TRANSPORTATION ROADWAY CONSTRUCTION PROJECTS, ALONG BUT NOT
LIMITED TO FLAGLER STREET AND 1ST STREET, MIAMI, FLORIDA; DIRECTING THE
CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO
GOVERNOR RICK SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE.
WHEREAS, the Florida Department of Transportation ("FDOT") is an executive agency
responsible for coordinating and planning the development of safe, viable, and balanced state
transportation systems; and
WHEREAS, in March 2016, FDOT began the first of four (4) roadway projects located on
Flagler and 1 St Street, Miami, Florida: 1) Flagler Street from 2711 Avenue to 1411 Avenue and
Southwest/Northwest 2711 Avenue from Southwest 10th Street to Northwest 91h Street; 2) Flagler
Street from 14th Avenue to 211 Avenue; 3) Southwest 1 St Street from Southwest 24th Avenue to
Southwest 17th Avenue; and 4) Southwest 1St Street from Southwest 17th Avenue to Southwest
6th Avenue, Miami, Florida ("Roadway Project"); and
WHEREAS, the reduction of travel lanes and temporary road closures coupled with
the excavation of roadways and sidewalks have caused a severe decrease in the mobility of
vehicular travel and foot traffic to local businesses along Flagler Street and 1St Street, Miami,
Florida, particularly the Roadway Project locations; and
WHEREAS, due to the obstruction of storefront access, the subsequent decrease in
patronage has resulted in local businesses experiencing major economic hardships, leaving
many in jeopardy of permanent closure; and
WHEREAS, the City of Miami ("City") is dedicated to promoting the prolonged success of
our resident business owners and has a vested interest in assuring a culture of accessibility for
all of our local market participants; and
WHEREAS, the City urges Governor Rick Scott and the members of the Florida
Legislature to implement a compensation package program for businesses along Flagler Street
and 1St Street, Miami, Florida, particularly the Roadway Project locations, and throughout the
State of Florida, who suffer from economic hardships by prolonged large scale FDOT
construction projects;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission urges Governor Rick Scott and the Florida Legislature
to implement a compensation package program providing funding for businesses adversely

effected by prolonged large scale FDOT roadway construction projects along but not limited to,
Flagler Street and 1 sl Street, Miami, Florida, particularly the Roadway Project locations.
Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor
Rick Scott and the members of the Florida Legislature.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
