• 100 NE 38th Street is not in the Special Area Plan ("SAP"), but is located in the Design District.
3704 NE 2nd Avenue is not in the SAP, but is also located in the Design District.
• 100 NE 38th Street is currently within the mural boundaries. The proposed amendment seeks to
exclude it.
• 3704 NE 2nd Avenue, is similarly situated, and is not being excluded from the mural boundary.
• Murals are still allowed in the area south of 1-195 and are visible from the SAP.
• We believe properties similarly situated, only 300 feet apart, should be treated equally.

Proposed Redevelopment
• Process started to redevelop the property. Conceptual designs were completed, but the project
was placed on hold due to the uncertainty surrounding this PZAB item.
• The property had a legally permitted mural in January 2015, but the permit owner moved the
permit in August 2016 due to the uncertainty of this PZAB item.
• Excluding 100 NE 38th Street from the boundary does not eliminate a mural from the City. There
will still be 35 permits. The mural permit would just move to a more concentrated area in the
Urban Core.
• We are willing to restrict placement of any mural so it is not visible from the SAP. We would
agree to similar concessions made by the property owner at 3704 NE 2nd Avenue.
• A proposal was made directly to Craig Robins. He insisted on sole discretion, when
redevelopment was complete whether a mural could ever be located on the property. We are
unable to make an agreement under those terms.
The property has been in our family for almost three decades. We would very much like to build
something that is a dramatic improvement over what is currently there, blends in with the
surrounding development, and hopefully contributes to the long term success of the Design
District.
