• 3704 NE 2nd Avenue is not in the SAP, but is also located in the Design District.
• 100 NE 38th Street is currently within the mural boundaries. The proposed amendment seeks
to exclude it. Any mural would not be visible from the SAP.
• 3704 NE 2nd Avenue, is similarly situated, and is not being excluded from the mural boundary.
• Murals are still allowed in the area south of 1-195 and are visible from the SAP.
• Properties similarly situated, only 300 feet apart, should be treated equally.
Ordinance SR2- Murals in the Special Area Plan ("SAP")
Good morning. My name is Michael Siegel and my family is the owner of 100 NE 38th Street. We have
owned this property for over 30 years.
We are here to ask the Commission to approve SR2 and accept the PZAB recommendation to allow our
property to maintain its mural permit rights by amending Exhibit "B" to include a cutout for our property.

We are the ONLY property owner in the Design District that is NOT in the Special Area Plan that is

negatively impacted by this Ordinance. We would therefore like the opportunity to address the
commission before this item comes to a vote. a
We are asking that you not remove this property right and not discriminate against our property. We are o
asking that you provide the same carve out provided the owner of 3704 NE 2"d Avenue which is a
property similarly situated to ours 300 feet to the east and all the owners South of 1-195 that are also in
the Design District. o

Our property and 3704 NE 2nd Avenue are the only properties on the North side of 1-195 that are not in
the Special Area Plan that would qualify for a mural permit.
We understand and appreciate the Design District's desire to limit murals in the "Special Area Plan",
however the rationale given for the boundary change is due to "murals within the Special Area Plan not
being in harmony with the development contemplated by the SAP". Our mural would face south and not
be visible to the SAP. To summarize our position:
a. Our property is NOT in the "Special Area Plan" which starts on the North Side of 38th Street.
b. Our neighbor, 3704 NE 2nd Ave is approximately 300 feet east of our property and on the same
side of the street. These are the only two properties not in the SAP North of 1-195 that meet the
regulation requirements to have a mural.
c. There are many existing properties on the South side of 1-195 that are considered part of the
Design District, but are NOT part of the SAP. Some of these properties have murals or would be
allowed to have murals in the future that would be visible from the SAP.
d. We are willing to restrict placement of any mural on our property to ensure it is not visible from
the SAP.
e. When this item was first presented we had a mural permit on our property and had already
made investments to redevelop the property. The project was placed on hold by the mural
permit owner and he subsequently moved the permit due to the uncertainty surrounding this
item. This item remained in PZAB for over 13 months.
f. By not granting a carve -out a mural is not eliminated. There are still 45 permits that the City of
Miami has granted. All it does is move the mural to a more concentrated and more likely
residential area in the Urban Core.
In conclusion, we are asking the commission to:
1. Not ignore the recommendation of the PZAB and modify Exhibit "B" on SR2 to carve out 100 NE
381h street and permit our property to maintain its mural rights.
2. Without modifying Exhibit "B" all properties in the Design District, but outside the SAP, are
eligible to have a mural, except our property, which is unjustified, discriminatory and unfair.
We hope the Commission modifies Exhibit "B" on SR2 with a cut out for 100 NE 38th Street and treats us
with equality and grants us the same rights as all other properties in the Design District that are not in
the SAP. Thank you for your consideration.
