Robin, good afternoon. Thank you for the opportunity to comment on the draft resolution. I have attached a redline
with a few tweaks to make two clarifications.
Notably, the 10 square foot discrepancy has nothing to do with the proposed improvements to the State's
leasehold. The discrepancy would have been identified and found at the next renewal or at any time the 20704 survey
would require review and approval of FDEP's relatively new Division of Bureau of Survey and Mapping, Below and
attached, you will find DEP BSM Jorge Alonso's May 16, 2017, conclusion that the 2004 legal description does not
"close" and therefore contains a scrivener's error. The attached redline clarifies that this modification corrects the
discrepancy.
]n addition, while the number of slips decrease, it is important to note that the potential billable lineal footage of
dockage increases with the proposed improvements. The attached redline clarifies this nuance.
I have requested authorization from DREAM to provide you with the latest draft Fifth Amendment.

Kirk/Tose, attached is the old lease description with changes from the new one highlighted in yellow. after re-
visiting the old lease and digitizing the legal 1 found that the legal does not close since 95M was not involved with
the Lease reviews back in the day. This and some of those differences could account for the differences in the
