A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A DATA SHARING AGREEMENT, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN MIAMI-DADE COUNTY
AND THE CITY OF MIAMI ("CITY") HOUSING OPPORTUNITIES FOR PERSONS
WITH AIDS PROGRAM TO SHARE RECIPIENT'S HEALTH DATA UNDER THE
HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPPA) OF 1996
IN AN EFFORT TO REPORT TO THE UNITED STATES DEPARTMENT OF HOUSING
AND URBAN DEVELOPMENT THE DIRECT RELATIONSHIP BETWEEN STABLE
HOUSING AND HEALTH OUTCOMES; AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.
Background of Item:
The Housing Opportunities for Persons with AIDS ("HOPWA") Program was created
under the AIDS Housing Opportunity Act and revised under the Housing and
Community Development Act of 1992.
The HOPWA program is requiring recipients to document health outcomes by showing
the health benefits housing assistance has, on current HOPWA Long Term Rental
Assistance (LTRA) recipients.
Many of these recipients are part of the Ryan White Part A program which is funded by
the U.S. Department of Health and Human Services and managed by Miami Dade
County.
To make the correlation between stable housing and health, the City HOPWA program
must access client's health data which the Ryan White program already has and is
willing to share with the City.
The Data Sharing agreement's purpose is to comply with the requirement of the Health
Insurance Portability and Accountability, Act of 1996 ("HIPPA").
The City Administration recommends the execution of the Data Sharing Agreement with
Miami Dade County to comply with the requirement of the "HIPPA", Act of 1996.

NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the Housing Opportunities for Persons with AIDS ("HOPWA") program was
created under the AIDS Housing Opportunity Act and revised under the Housing and
Community Development Act of 1992; and
WHEREAS, the HOPWA program is requiring recipients to document health outcomes
to demonstrate the health benefits of housing assistance on current HOPWA Long Term Rental
Assistance ("LTRA") recipients; and
WHEREAS, many LTRA recipients are part of the Ryan White Part A program ("Ryan
White Program") which is funded by the United States Department of Health and Human
Services and managed by Miami -Dade County; and
WHEREAS, the Data Sharing agreement will be constructed to comply with the
requirements of the Health Insurance Portability and Accountability ("HIPPA") and the HOPWA
program; and
WHEREAS, the City Administration recommends the negotiation and execution of an
Agreement with Miami -Dade County to share data contained in the Ryan White Program in a
manner that complies with the requirements of the HIPPA;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to negotiate and execute an Agreement, in a
form acceptable to the City Attorney, between Miami -Dade County and the City's HOPWA
program to share recipient's health data under HIPPA to report to the United States Department
of Housing and Urban Development the direct relationship between stable housing and health
outcomes.
Section 3. The City Manager is authorized' to execute any and all necessary
documents, in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
