At this time, the City and Flagstone were also seeking a modification to a deed restriction from the State of Florida, for whicr the City was receiving some pushback. Eventually, the City and the State reach an agreement by which the State of Florida would take a 15% stake in part of tf project. Submitted into the publiS record f ite (s) 1 on 5 Q , �7 City Clerk FLAGSTONE TIMELINE ► September 2010 The City agreed to a Fourth Amendment to Agreement to Enter, which allowed Flagstone to develop the project on a "component by component" basis for the first time, dividing the project into three (3) components: (1) Marina Componer (2 Parking/Retail Component; and (3) Hotel Component. This amendment also adopted Composite Attachment 3, which provides for various construction deadlines and City termination rights. ► September 2011 The State of Florida and the City executed an agreement to modify the deed restriction which had originally prohibited conveyance of the land for private use/purposes. ► May 2014 Flagstone entered into Ground Lease with the City for Marina Component Submitted into the public record fiqr ite(s) on l . City Clerk FLAGSTONE TIMELINE ► March 2016 A Temporary Use of Vacant Land Permit for pop up restaurant was approved by the City. ► September 2016 Temporary Use Permit expired on the 26th of September of last year. The restaurant continued to operate without a permit. '* October 2016 The City and Flagstone execute a Ground Lease for the parking/retail Compone on October 11 ► January 2017 Flagstone received Notice of Violation from Code Compliance for operating a restaurant without a Certificate of Use and various health and safety violations Submitted into the public record on City Clerk FLAGSTONE TIMELINE ► March 2017 Flagstone was ordered by the State of Florida Department of Business and Professional Regulation (DPBR) to shut down the restaurant and was cited for Y violations of health and food safety regulations ► April 2017 Flagstone was notified that they were delinquent on over $750,000 worth of property taxes, due no later that May 31, 2017. ► May 2017 Flagstone paid outstanding property taxes on May 22, 2017, just before the May 31 deadline.
