GENERAL INFORMATION: FILE ID: 1644 COMMISSION DISTRICT: District 4 REQUEST: Pursuant to Article 5 and Article 7, Section 7.1.2.8 of Ordinance 13114, as amended, Coral Way Acquisitions, LLC herein after referred to as the applicant is requesting a change of zoning for two parcels. The parcel 1 (3252 SW 22 Street) is split zoned T5-0 (Urban Center Transect — Open) on the northern portion of the parcel and T4 - R (General Urban Transect — Restricted) on the southern portion of the parcel. The parcel 2 (3277 SW 22 Terrace) is located immediately southwest of the parcel 1 and is zoned T4 -R (General Urban Transect — Restricted). The subject properties form part of the Miami Suburban Acres Subdivision and are located within the Coral Way NET area. The parcels combined lot area is approximately 1. 15 acres of which approximately .93 acres is the subject of this rezoning request. The complete legal description is on file with the Hearing Boards Section. B. BACKGROUND: The subject site is comprised of two individually plated lots with parcel 'I located at 3252 SW 22 Street, zoned "T5-0" on the northern portion of the parcel (abutting 22 street), which is the current site of a Sergio's Restaurant, and T4 -R on the southern portion of the parcel, which is an existing legal non -conforming parking lot for the restaurant. Sergio's Cuban Family Restaurant herein after referred to as the restaurant was founded in 1975 and it is a third generation operated restaurant. The Coral Way location first opened in 1992 and is a women minority owned small business. On August 28, 2016 pursuant to Exhibit A, the applicant acquired the abutting parcel 2 located at 3277 SW 22 Terrace, zoned T4 -R in an effort to provide additional parking for the restaurant patrons. The applicant is requesting a change of zoning to permit the construction and expansion of the parking area for the existing restaurant. Until recently the subject parcel had a single-family residence with multiple code violations, but has since been demolished and code violations have been cleared. File ID: 1644 Page 1 of 5 The properties were zoned Restricted Commercial "C-1" parcel 1 (3252 SW 22 Street) and Two -Family Residential District "R-2" parcel 2 (3277 SW 22 Terrace) under the previous zoning code (11000) and were subsequently rezoned on April 2010 under the adoption of Miami 21 to Urban Center/ General Urban Transect 75-0I T4 -R" and General Urban Zone Transect 74-R", respectively. The applicant is currently seeking a change of zoning from T4 -R (General Urban Transect —Restricted) to T4 -L (General Urban Zone — Limited) of the southern half of parcel 1 (3252 SW 22 Street) with the northern portion retaining its current zoning of T5-0, and a complete rezoning of parcel 2 (3277 SW 22 Terrace) from T4 -R to T4 -L. The applicant has proffered a covenant, attached hereto as Exhibit B entitled "Covenant" restricting the uses solely to parking to support Sergio's restaurant or other business located on the Sergio's Parcel. No other commercial establishment, business, office or other property will be allowed to use or access the parking situated on the subject properties. C. COMPREHENSIVE PLAN: The requested zoning designation of T4 -L maintains the identified land -use of the current Miami Comprehensive Neighborhood Plan (MCNP) designation of Low Density Restricted Commercial. D. ANALYSIS: The following is a review of the request pursuant to a rezoning criteria at Article 7, Section 7.1.2.8 (a)(3) and (f)(2) of Miami 21. The Background section of this report is hereby incorporated into the analysis and its corresponding criteria by reference: Criteria: For rezoning: A change may be made only to the next intensity Transect Zone or by a Special Area Plan, and in a manner which maintains the goals of the Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and building heights. Analysis: Parcel 1, 3252 SW 22 Street and Parcel 2, 3277 SW 22 Terrace are legally platted parcels located within the Miami Suburban Acres Subdivision. Staff finds the proposed zoning request is inconsistent with the goals of the Miami 21 Code as the request is not compatible with the surrounding zoning districts. Staff notes that the southern portion of 3252 SW 22 Street and 3277 SW 22 Terrace parcel directly abuts a T4 -R to the east and west, and abut a T3-0 to the south. Said rezoning would allow for the intrusion of commercial uses such as, but not limited to, General Commercial, Entertainment and Food Establishment uses. CONCLUSION: No Objection pursuant to Exhibit C No Objection No Objection No Objection No Objection pursuant to Exhibit D No Objection The Department of Planning and Zoning recommends denial of the applicant's request for a change of zoning for parcel 1, 3252 SW 22 Street, and parcel 2, 3277 SW 22 Terrace. The proposed change of zoning is not compatible with the surrounding zoning districts. As such, the proposed request would be incompatible as there is are T4 -L adjacent to the properties. The applicant has proffered a covenant restricting the uses solely for parking to support Sergio's restaurant or other business located on the Sergio's Parcel, with no other commercial establishment, business, office or other property allowed to use or access the parking situated on the subject properties. However, the applicant's request to rezone the subject properties to T4 -L and restrict the uses to parking only do not merit a change of zoning as said request does meet the criteria as described in Article 7, Section 7.1.2.8 of Miami 21 Code. Staff finds the zoning request for parcel 1, 3252 SW 22 Street, and parcel 2, 3277 SW 22 Terrace are inconsistent with the goals of the Miami 21 Code as the request is not compatible with the surrounding zoning districts nor provides an appropriate zoning transition. H. Accordingly, the site plan is approved by DERM. PotableWater Service and Wastewater Disposal Public water and public sanitary sewers can be made available to the subject property. Therefore, connection of the proposed development to the public water supply system and sanitary sewer system shall be required in accordance with Code requirements. Notwithstanding the foregoing, and in light of the fact that the County's sanitary sewer system has limited sewer collection, transmission, and treatment capacity, no new sewer service connections can be permitted, unless there is adequate capacity to handle the additional flows that this project would generate. Consequently, final development orders for this site may not be granted if adequate capacity in the system is not available at the point in time when the project will be contributing sewage to the system. Lack of adequate capacity in the system may require the approval of alternate means of sewage disposal. Use of an alternate means of sewage disposal may only be granted in accordance with Code requirements, and shall be an interim measure, with connection to the public sanitary sewer system required upon availability of adequate collection/transmission and treatment capacity. Stormwater Management Stormwater shall be retained on site utilizing properly designed seepage or infiltration drainage system. Drainage plans shall provide for full on-site retention of the stormwater runoff generated by a 5 -year 1 1 - day storm event. Site grading and development plans shall comply with the requirements of Chapter 11C of the Code, as well as with all state and federal criteria, and shall not cause flooding of adjacent properties. Any proposed development shall comply with county and federal flood criteria requirements. The proposed development order, if approved, will not result in a reduction in the LOS standards for flood protection set forth in the CDMP subject to compliance with the conditions required for this proposed development order. MZ2017000002 Coral Way Acquisition Properties, LLC Tree Preservation The site is within the boundaries of the City of Miami. Therefore, the applicant should contact the City of Miami at (365)416-1400 or (305)416-1551 for any information relating to tree preservation requirements. Pursuant to the minimum requirements of Section 24-49.9 of the Code, should there be exotic pest plant and nuisance species as listed in Section 24-49.9 of the Code present on the subject property, they shall be removed prior to development or redevelopment and developed property shall be maintained to prevent the growth or accumulation of prohibited species. Enforcement History There are no open or closed enforcement records for violations of Chapter 24 of the Code for the subject property. Refer to the City's Right of Way Tree List/Species Acceptable Under Powerlines list. Trees that meet this criteria for street trees include but are not limited to: Simpson stopper, spanish stopper, white stopper, tabebuia chrysotricha, bottlebrush, spicewood, and wild olive. 2. Ensure that planting spaces proposed for the Mahogany and Dahoon Holly trees have adequate planting space for this species. 3. Proposed construction mast be consistent with the adequate preservation of existing trees. The Critical Root Zones of existing trees must be protected and not impacted.
