Miami, FL 33130 Re: FILE ID. 1209 —An exception to restore a non -conforming use of the property located at 2225 SW 18 Avenue, Miami, FL 33145 Dear all: Unfortunately, I will not be able to attend this hearing, given the short notice. However, I decided to leave this letter hoping that my voice, along with that of many of my neighbors is heard. I am also asking that this letter becomes part of the records of this hearing. I found with dismay that the City of Miami Planning and Zoning Department has recommended an exception to restore a non -conforming use to the property located at 2225 SW 18 Avenue, Miami, FL. As the resident owner of the house located_ right_ across the street (22nd Terrace) from the parking lot of the propertV in question, I strongly oppose this exception to the zonin code. Throughout my almost thirty years of residence at this location, I have witnessed and endured the results that "non -conforming" uses have brought to our neighborhood: added traffic and parking, driveways and handicapped crossings blocked, cars being hit and side -scratched, strangers walking around the neighborhood, noise, trash in front yards, sidewalks and streets, and break-ins. In addition to the physical decay that our neighborhood has suffered, I have to mention the frequent instances of unknown people knocking at my door asking for directions, or to use my phone, and even my bathroom, or asking for help to jump start stalled cars; and what lately is becoming a trend, music and screaming blasted from loudspeakers at the neighborhood for hours uninterrupted when nearby businesses have events, as what just happened last Thursday. To live within a residential community might be the most important factor when a family decides to buy a house to live and raise children, hence, the permanence of the character of the community and the quality of life must be guaranteed. Tax -paying property owners and residents of the city depend and rely on existing zoning laws; and trust the professionalism, experience and wisdom of the officials who enforce them. It is not necessary to remind the members of the board, that under the existing zoning code a T3 -R zoned property (as the one in question) office uses are not permitted, as this is acknowledged in the "Analysis for Exception" that they produced; however and inexplicably, the Planning Department had concluded in their analysis approval of the exception. Under Miami2l, the "model' code recently adopted by our city; T3 -R zoning is dedicated to residential uses. The Planning and Zoning Department should not support "non -conforming uses" that are particularly not allowed under this zoning. Furthermore, the practice of granting "non -conforming uses" will further encourage corporations to lure homeowners near major arteries (Coral Way, 17'h Avenue, etc.) to sell their properties. If this practice is allowed; our residential neighborhoods will soon be commercial districts. The role of the Planning and Zoning Department must be the enforcement of existing zoning regulations and the safeguard of the property values of all property owners. Again, the character of our community and the quality of life of its residents must be protected, preserved and enhanced. I sincerely hope that after witnessing the opposition of so many residents living on 5W 22 Terrace and 18th Avenue that are immediately impacted, you support the homeowners and vote to deny this exception.
