Subject: Sole Source - Airhawk Exhaust System
Purpose of Item:
The purpose of this item is to authorize a resolution of the Miami City Commission, with
attachments, by a four-fifths (4/5) vote, pursuant to Section 18-92 of the Code of the
City of Miami, Florida, as amended, after an advertised public hearing, ratifying,
approving and confirming the City Manager's finding of a sole source; waiving the
requirements for competitive sealed bidding procedures and approving the request to
enter into an agreement with Garrison Mechanical Service Corporation d/b/a Garrison
Mechanical, the sole authorized dealer within southeastern Florida, of the Airhawk
Exhaust Removal System ("Airhawk"), for the design and installation of one (1) Airhawk
at Fire Station 12, for the Department of Fire Rescue ("Fire"), for a price not to exceed
$86,683.09; allocating funds from Fire General Operating Fund, Account No. 40-
B70184.05.1426; and further authorizing the City Manager to negotiate and execute all
other documents, including any amendments and modifications to the agreement, in a
form acceptable to the City Attorney, as may be necessary for said purpose.
Background of Item:
Fire is seeking to procure an Airhawk, which will be installed in Fire Station 12.
Previously, in 2015, through Invitation for Bid (IFB) 371334, Fire purchased ten (10)
Airhawks, which were installed within Fire Stations 1 through 10. The purchase and
installation of the same system within Fire Station 12, will ensure the uniformity among
all the exhaust removal systems owned by Fire, which will in turn, reduce the cost and
complexity of required maintenance for these critical life -safety devices.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN
ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING
THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS EXHIBIT
"A", OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE
SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF ONE
(1) AIRHAWK AIR QUALITY AND EXHAUST REMOVAL SYSTEM ("AIRHAWK
EXHAUST SYSTEM") AT FIRE STATION NO. 12 INCLUDING INSTALLATION FROM
GARRISON MECHANICAL SERVICE CORPORATION D/B/A GARRISON
MECHANICAL ("GARRISON") FOR THE DEPARTMENT OF FIRE -RESCUE ("FIRE")
FOR AN AMOUNT NOT TO EXCEED $86,683.09 FROM THE FIRE -RESCUE
GENERAL OPERATING FUND, ACCOUNT NO. 40-B70184.05.1426; AUTHORIZING
THE CITY MANAGER TO EXECUTE THE PROFESSIONAL SERVICES AGREEMENT
("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM; FURTHER AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS,
INCLUDING ANY AMENDMENTS, RENEWALS AND MODIFICATIONS TO THE PSA,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY
FOR SAID PURPOSE.
WHEREAS, harmful exhaust fumes from diesel engines that remain in fire stations when
diesel -powered apparatus enter or leave requires the installation and maintenance of exhaust
removal systems thereby eliminating toxic fumes and making fire stations safer; and
WHEREAS, in 2015, the Department of Fire -Rescue ("Fire") purchased ten (10) Airhawk
Air Quality and Exhaust Systems ("Airhawk Exhaust System") from Garrison Mechanical
Service Corporation d/b/a Garrison Mechanical ("Garrison"), which were installed in Fire
Stations 1 through 10, pursuant to Invitation for Bid ("IFB") No. 371334; and
WHEREAS, Fire needs an new exhaust removal system for Fire Station 12; and
WHEREAS, the installation of the Airhawk Exhaust System in Fire Station 12 will reduce
the cost and complexity of required maintenance since the same system was installed in Fire
Stations 1 through 10; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has adopted a finding that Garrison is the
sole source dealer of the Airhawk Exhaust System; and
WHEREAS, the finding of the Chief Procurement Officer has been approved and
adopted as the City Manager's finding, attached and incorporated as Exhibit "A"; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive sealed bidding procedures be waived and that the procurement of
Airhawk Exhaust System be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City
Code, after an advertised public hearing, the City Manager's finding, attached and incorporated
as Exhibit "A", of a sole source is ratified, approved and confirmed, the requirements for
competitive sealed bidding procedures are waived, and the procurement of one (1) Airhawk at
Fire Station 12 including installation from Garrison for Fire for an amount not to exceed
$86,683.09 is approved.
Section 3. Funds are to be allocated from Fire -Rescue General Operating Fund,
Account No. 40-B70184.05.1426.
Section 4. The City Manager is authorized' to execute the Professional Services
Agreement ("PSA"), in substantially the attached form, with Garrison, the sole source dealer of
Airhawk.
Section 5. The City Manager is further authorized' to negotiate and execute all other
documents, including any amendments and modifications to the PSA, in a form acceptable to
the City Attorney, as may be necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
