HomeMy WebLinkAboutR-17-0084City of Miami Legislation Resolution R-17-0084 File Number: 1663 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/23/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") LEASE AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, PROVIDING FOR THE LEASE OF THE FDOT-OWNED PROPERTY KNOWN AS FDOT PARCEL 565, LOCATED UNDERNEATH WEST FLAGLER BRIDGE, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" OF THE AGREEMENT ("LEASE AREA"), AT NO COST TO THE CITY OF MIAMI ("CITY'), FOR AN INITIAL TERM OF TEN (10) YEARS WITH ONE (1) OPTION TO RENEW TERM FOR AN ADDITIONAL TEN (10) YEARS, FOR THE PURPOSE OF PROVIDING A COMMUNITY RECREATIONAL AREA FOR PUBLIC USE, WITH TERMS AND CONDITIONS MORE PARTICULARLY DESCRIBED IN THE AGREEMENT. WHEREAS, the Florida Department of Transportation ("FDOT") is the owner of the property known as FDOT Parcel 565, located underneath the West Flagler Bridge ("Lease Area"), as more particularly described in Exhibit "A" of the Lease Agreement ("Agreement"); and WHEREAS, FDOT desires to lease to the City of Miami ("City"), at no cost to the City, the Lease Area, for an initial term of ten (10) years with one (1) option to renew term for an additional ten (10) years, for the purpose of providing a community recreational area for public use, with terms and conditions more particularly described in the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the Agreement, in substantially the attached form, between the City and FDOT, for the Lease Area at no cost to the City, for an initial term of ten (10) years with one (1) option to renew term for an additional ten (10) years, for the purpose of providing a community recreational area for public use, with terms and conditions more particularly described in the Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
