SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
LOCATION: Approximately 3245 SW 23 St [Commissioner Manolo Reyes - District 4]

PURPOSE: This will change the above property from "73-0" Sub -Urban Transect Zone -Open
to "74-R" General Urban Transect Zone -Restricted.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE ZONING ATLAS
OF ORDINANCE NO. 13114, AS AMENDED, CHANGING, IN PART, THE ZONING
CLASSIFICATION FROM 73-0," SUB -URBAN TRANSECT ZONE -OPEN, TO 74-R,"
GENERAL URBAN TRANSECT ZONE -RESTRICTED, OF THE REAL PROPERTY
LOCATED AT APPROXIMATELY 3245 SOUTHWEST 23 STREET, MIAMI, FLORIDA, AS
MORE PARTICULARLY DESCRIBED HEREIN AND IN EXHIBIT "A"; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on
November 15, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-
17-087 by a vote of seven to zero (7-0), Item No. PZAB.2, recommending denial of the zoning
change as stated herein; and
WHEREAS, the property located at approximately 3245 Southwest 23 Street, Miami,
Florida ("Property") is currently zoned 73-0," Sub -Urban Transect Zone -Open; and
WHEREAS, Twenty Three Project, LLC ("Applicant") has submitted a request to change
the zoning classification of the Property to 74-R," General Urban Transect Zone -Restricted;
and
WHEREAS, the City Commission has considered the goals, objectives, and policies of
the Miami Comprehensive Neighborhood Plan ("MCNP"); Ordinance No. 13114, as amended,
the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); all other City of Miami
("City") regulations; and all evidence in the public record relative to this zoning change; and
WHEREAS, in light of the limitations, restrictions, and conditions on the development of
the Property, the zoning change as stated herein may partially be considered as being in
conformity with the applicable regulations and supported by competent, substantial evidence
pursuant to Section 7.1.2.8 of the Miami 21 Code and thus should be approved in part; and
WHEREAS, the request for a zoning change for the Property from 73-0," Sub -Urban
Transect Zone—Open, to 74-R," General Urban Transect Zone—Restricted, is denied in part for
Lot 75, which will remain 73-0," Sub -Urban Transect Zone—Open, and approved in part as to
the requested zoning change from 73-0," Sub -Urban Transect Zone—Open, to 74-R," General
Urban Transect Zone—Restricted, for the Western '/2 of Lot 76, Block 4 of the Amended Plat of
MIAMI SUBURBAN ACRES, according to the Plat thereof, as recorded in Plat Book 4, Page 73
of the Public Records of Miami -Dade County, Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.

Section 2. The City Commission grants, in part, the amendment to the Zoning Atlas of
Ordinance No. 13114, as amended, by changing the zoning classification from "73-0", Sub -
Urban Transect Zone—Open, to "74-R", General Urban Transect Zone -Restricted, for the
Property only as to that portion of the Property which is the Western '/2 of Lot 76, Block 4, of the
Amended Plat of MIAMI SUBURBAN ACRES, according to the plat thereof, as recorded in Plat
Book 4, Page 73 of the Public Records of Miami -Dade County, Florida, as more particularly
described in Exhibit "A", attached and incorporated.
Section 3. The City Commission denies, in part, the zoning change as to Lot 75.
Section 4. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof pursuant and subject to Section 163.3187(5)(c), Florida Statutes.'

' This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
