Welcome to the City of Miami! This application is intended to serve as a guide in assisting you
with our public hearing process. Please feel free to contact us, should you have any questions.
There is no deadline to submit this application as it is presented semi-annually to the Planning,
Zoning and Appeals Board and the City Commission. The application submittal elate is the
date stamped by Hearing Boards' staff on this page. The responses to this application must
be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.
The applicant is responsible for the accuracy of the information contained in the application and
all supporting materials. Should you wish, you could bring the materials to our office for review
prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city
commission. All documents, reports, studies, exhibits (8'/2x11") or other materials submitted
during this process will be kept as part of the record. Any documents offered to the Planning,
Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15)
days before the meeting as part of the agenda materials will be entered into the record at the
discretion of the aforementioned Board and Commission.
ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE
STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR
EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST
WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY
STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID
ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL),
LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133.
Ordinance No. 12918 states that each person or entity requesting approval, relief or other action
from the City Commission or any of its boards, authorities, agencies, councils or committees
regarding any issue, shall disclose at the commencement (or continuance) of the public
hearing(s) on the issue, any consideration provided or committed, directly or on its behalf, for an
agreement to support or withhold objection to the requested approval, relief or action. The
Disclosure of Consideration Provided or Committed for Agreement to Support or Withhold
Objection Affidavit included in this package must be submitted with the application. The
applicant must, at the commencement of any public hearing on the issue, if there is any
disclosure to report, read the disclosure into the record. Also, the applicant must supplement
the affidavit if there is any new information or additional information to disclose.

Our firm represents 20' Avenue Partners LLC (hereinafter, "Partners" or "Applicant
of an assemblage of land comprised of two (2) folios and located at approximately 3616 & 3
Avenue, Miami, FL (the "Property"). On or about July 19, 2017, Partners submitted an app
Future Land Use ("FLUM") amendment from Medium Density Restricted Comme
Commercial to High Density Multifamily Residential and a companion rezoning from i
Transect Zone Limited (T5 -L) and Urban Core Transect Zone Open (T6-8-0) to a unified d
Urban Core Transect Zone Open (T6-8-0) (the "Application").
Following the submittal of the Application, a supplemental letter of intent was sent b
of Mr. Ryan Shedd, Planner II, Department of Planning (the "Department"), on Septemb
seeking to modify our requested FLUM and transect designations in the Application to a FLU]
of High Density Multifamily Residential and a transect designation of Urban Core T
Residential (T6 -8-R) (the "Amended Request"). Said Amended Request was submitted in
recommendation from staff following initial discussions related to the Application.
Subsequent to the submittal of the Amended Request, additional discussion with Del

Request in a manner consistent with the Application. As such, this letter will serve to formally

The Future Land Use Map (FLUM) amendment and rezoning request, provided as direct referral by the
Office of Zoning, is subject to review for compliance with the requirements of the Miami Comprehensive
Neighborhood Plan (MCNP), the City of Miami Code of Ordinances, and Miami 21 Code, as well as other
applicable county and state regulations.
The following comments were generated based on the request for a pre -application meeting and attached
documents, and the Pre -Application meeting held with the applicant and representatives of Div. of Land
Development and the on Thursday, June 08, 2017, to discuss the request.
GENERAL INFORMATION /ALTERNATE REQUESTS:
This request, as proposed, is looking to secure a hearing in the next rezoning cycle, which last date
for Pre -application meeting is Monday, June 12, 2017.
The subject property consist of 2 parcels owned by the same owner and comprising approximately
22,530 square feet, as depicted in Table 1.

Request purpose:
The owners collectively referred as "The Applicant" proposes to rezone the subject parcels, or portion
of them, currently designated with T5 -L (Urban Center Transect Zone- Limited) to T6-8-0 (Urban
Core Transect Zone - Open).
The rezoning requested rezoning requires for a revision of the FLUM designation, therefore pursuant
to Policy LU -1.6.4 of the Miami Comprehensive Neighborhood Plan and Section 62-8 of the
Municipal Code for the City of Miami, the applicant is requesting through a companion item, the FLUM
amendment of the subject properties from Medium Density Restricted Commercial and General
Commercial to General Commercial, as depicted in Table 2.

The Division of Land Development of the Planning and Zoning Department confirms the applicant
may submit an application of rezoning with the following conditions:
During the meeting staff explained that the Department will receive only complete applications,
hence encourage the applicant to apply before this cycle deadline (July 21, 2017) in that way
creating a cushion time to allow resolving any potential situation of a deemed incomplete
application.
2.Staff proposed the applicant to re-evaluate the FLUM amendment request considering "High
Density Multifamily Residential" instead General Commercial
3. During the pre -application meeting, staff requested the applicant to provide at the time of the
application, all the documentation required for rezoning including appropriate surveys for each
request as provided for the application to submit, a drafted covenant in lieu of unity of title, as well
as any voluntarily preferred Declaration of Restrictive Covenant, in Word version to allow staff
comments and reviewed for legal form and correctness by City Attorney.
4.The letter of intent provided in form of narrative may cover both applications (FLUM amendment
and rezoning), however shall include a specific set of criteria for each analysis.
5.The required surveys must provide Lot size and applicable dimensions for each request, including:
Frontages, depth, and widths.
6. Provide school concurrency application with the Comprehensive Plan Amendment application. The
application may be downloaded from the Hearing Boards Division's website.

7.Applicant shall pay special attention to Miami 21 Code, Sec. 7.1.2.8 (c)(2) which provides for the
minimum information required as part of the rezoning application, as follows:
a. Location of the property, including address and legal description
b. Survey of the property prepared by a State of Florida registered land surveyor within six
(6) months from the date of the application, including acreage.
c. Affidavit and disclosure of ownership of all owners and contract purchasers of the
property, including recorded warranty deed and tax forms of the most current year. For
corporations and partnerships, include articles of incorporation, certificate of good
standing, and authority of the person signing the application. Non-profit organizations
shall list members of the Board of Directors for the past year.
d. Certified list of owners of real estate within five hundred (500) feet of the subject
property.
e. Present zoning of the property and Future Land Use designation of the property.
f. At least two photographs that show the entire property.
g. An analysis of the properties within a one-half mile radius of the subject property
regarding the existing condition of the radius properties and the current zoning and
Future Land Use designations of the radius properties. The analysis shall include photos
of Building elevations of both sides of the street extending three hundred (300) feet
beyond all boundaries of the site. An aerial photo of the site and the radius properties
shall be included. The analysis shall explain why the zoning change is appropriate and
why the existing zoning is inappropriate, in light of the intent of the Miami 21 Code and
particularly in relation to effects on adjoining properties.
8. Relative to Florida Statute 163.3177 (6) j. 8. and 9., please address the following as it relates to
your proposal:
a. Provide an analysis of the availability of facilities and services, in particular Public
Works, Solid Waste Collection, Parks and Open Space, and Capital Improvements.
b. Provide an analysis of the suitability of the plan amendment for the proposed use
considering the character of the undeveloped land, soils, topography, natural resources,
and historic resources, if any, on site.
c. Address how your project discourages the proliferation of urban sprawl, in particular,
please address the following:
i. The intensity, density, and uses and suitability of such for the proposal.
ii. The proposal's ability to adequately protect and conserve natural resources, such
as wetlands, floodplains, environmentally sensitive areas, the natural
groundwater aquifer recharge areas, and similarly sensitive areas.
iii. The extent to which the proposal will maximize use of existing public facilities and
services.
iv. The extent to which the proposal will maximize use of future public facilities and
services.
v. The extent to which the proposal will allow for land use patterns or timing which
increase the cost in time, money and energy of providing and maintaining
facilities and services, including roads, potable water, sanitary sewer, stormwater

response, and general government.
vi. The extent to which the proposal encourages or inhibits infill development or
redevelopment of existing neighborhoods and communities.
vii. The extent to which the proposal encourages a functional mix of uses.
viii. The extent to which the proposal results in accessibility among linked or related
land uses.
ix. The extent to which there is a result in lost functional open space.
x. Directs or locates economic growth and associated land development in a
manner that does not have an adverse impact on natural resources, but
ecosystems.
A Promotes walkable and connected communities and provides for compact
development and a mix of uses at densities and intensities that will support a
range of housing choices and a multimodal transportation system, including
pedestrian, bicycle, and transit.

10. Compliance with deadlines for submittal and follow staff recommendations provided on the pre -

obtain the favorable recommendation of the Planning and Zoning Department.
