Subject: Revision to interlocal agreement with FDOT
Purpose of Item:
Resolution authorizing the City Manager to execute a Maintenance Memorandum of Agreement
with the Florida Department of Transportation for the City of Miami to maintain the medians
along State Road (S.R.) 972 (Coral Way) (SW 22nd Street) from Southwest 31 st Avenue to
Southwest 30th Court and along State Road (S.R.) 972 (Coral Way) (SW 22nd Street) just East
of Southwest 33rd Avenue, Miami, Florida, ("Project Limits") which is part of the Pilot Program
for the Coral Way Medians Project, B-30909, to be installed by the City.
Background of Item:
The Florida Department of Transportation has jurisdiction over State Road (S.R.) 972 (Coral
Way) (SW 22nd Street) from Southwest 30th Court to Southwest 33rd Avenue, Miami, Florida,
and requires a Maintenance Memorandum of Agreement as a condition of approval. The City
has drafted design plans for beautification improvements within the median along this roadway
as part of a Pilot Program and the City has agreed to maintain said improvements in
accordance with the terms and conditions set forth in the Agreement. Given the nature and the
duration of the Pilot Program, there is no budgetary fiscal impact at this time other than those
expenditures already appropriated and approved by City Commission under Project B-30909.
In addition, the City also has an active maintenance contract to maintain the landscaping
(excluding the banyan trees) within the medians along the Project Limits.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE
MEMORANDUM AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
THE FLORIDA DEPARTMENT OF TRANSPORTATION, PROVIDING THAT THE CITY
OF MIAMI ("CITY") MAINTAIN THE IMPROVEMENTS WITHIN THE MEDIANS
LOCATED AT STATE ROAD ("S.R.") 972 (CORAL WAY/SW 22ND STREET) FROM
SOUTHWEST 31 ST AVENUE EAST TO SOUTHWEST 30TH COURT, AND AT S.R.
972 (CORAL WAY/SW 22ND STREET) JUST EAST OF SOUTHWEST 33RD
AVENUE, MIAMI, FLORIDA, WHICH IS PART OF THE CITY'S PILOT PROGRAM FOR
THE CORAL WAY MEDIANS PROJECT, B-30909.
WHEREAS, the City of Miami ("City") will install synthetic turf, decorative rocks, and
pavers ("Improvements") in accordance with the design plans for the City's Coral Way medians
Pilot Program Project B-30909, along State Road ("S.R.") 972 (Coral Way/SW 22nd Street) from
Southwest 31 st Avenue East to Southwest 30th Court, and along S. R. 972 (Coral Way/SW
22nd Street) just East of Southwest 33rd Avenue ("Project Limits"), in an effort to provide an
improved quality of life to City residents; and
WHEREAS, the Florida Department of Transportation ("FDOT") is the owner of the
Right -of -Way within the Project Limits where the Improvements will be installed; and
WHEREAS, FDOT has approved the Improvements within the Project Limits and
requires a Maintenance Memorandum of Agreement ("Agreement") as a condition of approval;
and
WHEREAS, the City has agreed to maintain said Improvements under the terms and
conditions set forth in the Agreement; and
WHEREAS, FDOT and the City have determined that it would be in the best interest of
the general public to enter into the attached Agreement, in substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT, providing that the City maintain the improvements within the
Project Limits according to the terms set forth in the Agreement.
' The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
