Prom. - Pedestrian and Bicycle Safety Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), establishing a new Special Revenue Project entitled: "Pedestrian and Bicycle Safety Enforcement Campaign 2017," authorizing the City Manager to execute a Letter of Agreement and Contract with the University of South Florida, in substantially the attached form, for reimbursing the City of Miami for overtime expenses, in an amount not to exceed $60,000.00; further authorizing the City Manager to designate the Chief of Police to execute any other necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance of said reimbursement of funds. No matching funds are required from the City of Miami. Background of Item: The intent of this contract is to utilize law enforcement support to enhance a comprehensive safety campaign that will educate pedestrians, bicyclists, and motorists of safe behaviors within high priority intersections within the City of Miami. The Traffic Enforcement Unit will be responsible for these enforcement activities. Education and enforcement activities may include warnings and/or citations to pedestrians, bicyclists, and motorists in accordance with Florida Statutes. Enforcement officers will distribute safety educational materials during all High Visibility Enforcement operations. According to the University of South Florida, this campaign is a component of Florida's Bicycle/Pedestrian Focused Initiative and is implemented by the University of South Florida under the direction of the Florida Department of Transportation. The University will provide the City of Miami copies of the required training materials, a copy of Florida's Pedestrian and Bicycle Strategic Safety Plan, and educational materials for distribution. City of Miami IIS°°1 il°4I° . °° Legislation Resolution Enactment Number: R-17-0037 File Number: 1520 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date:1/26/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT, ENTITLED "PEDESTRIAN AND BICYCLE SAFETY ENFORCEMENT CAMPAIGN 2017"; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE UNIVERSITY OF SOUTH FLORIDA, IN SUBSTANTIALLY THE ATTACHED FORM, TO BE USED TO REIMBURSE THE CITY OF MIAMI FOR OVERTIME EXPENSES, IN AN AMOUNT NOT TO EXCEED $60,000.00; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF SAID REIMBURSEMENT FUNDS. WHEREAS, the Florida Department of Transportation (TDOT"), through a Task Work Order with the University of South Florida ("USF"), utilizes local law enforcement support to educate and enforce safe pedestrian, bicyclist, and driver behaviors in high priority counties throughout Florida; and WHEREAS, this campaign is a component of Florida's Bicycle/Pedestrian Focused Initiative managed by USF under the direction of FDOT; and WHEREAS, the objective of the initiative is to reduce traffic crashes and fatalities involving pedestrians and bicyclists using traffic enforcement details and community education; and WHEREAS, this agreement is intended to utilize the support of the Miami Police Department ("MPD") by allotting funds to educate and enhance a comprehensive safety campaign that promotes safe pedestrian, bicyclist, and driver behaviors within high priority intersections throughout the City; and WHEREAS, this high visibility enforcement program is managed through agreements, not grants, and FDOT has allotted program funds in an amount not to exceed $60,000.00 to fund overtime pay for MPD officers conducting on -street enforcement operations that promote pedestrian and bicycle safety or making on -street contacts with the public to deliver the initiative's safety messages; and WHEREAS, the MPD's Traffic Enforcement Unit has prepared a program plan for purposes of conducting said enforcement and education; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: Pedestrian and Bicycle Safety Enforcement Campaign 2017 RESOURCES: University of South Florida and FDOT: $60,000.00 APPROPRIATIONS: Reimbursement of overtime expenses: $60,000.00 Section 3. The City Manager is authorized' to execute this agreement, and any accompanying documents, with the University of South Florida, in substantially the attached form, for reimbursing the City for overtime expenses, in an amount not to exceed $60,000.00, for MPD officers conducting traffic enforcement details and community education activities consistent with the Pedestrian and Bicycle Safety Enforcement Campaign. Section 4. The City Manager is further authorized' to designate the Chief of Police to execute the necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance of said reimbursement funds. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
