The site is centrally located along NW 2m' Avenue just 1 block north of the Wynwood NRD-1 boundaries, and two blocks west of Midtown Miami, with great access to transit, schools, and community services, as well as shopping and new employment opportunities on the horizon. Specifically, the properties that are the subject of this application include those fronting on NW 3011 Street located at 221-291 NW 301h Street, consisting of approximately 73,745 square feet of lot area ("South Parcels"); and the properties fronting on NW 31s' Street located at 224-284 NW 3151 Street, 3043 NW 3 Avenue, and the western portion of 3040 NW 2nd Avenue, consisting of approximately 73,836 square feet of lot area ("North Parcels", collectively with the South Parcels referred to as the "Subiect Properties"),' ' See "Exhibit A" for a detailed description of the North Parcels and the South Parcels. Note that the Applicant also owns 2kdMbM.e.9fflguous properties fronting on NW 29d Avenue as part of the assemblage of the entire block, which are already zoned T5-0 with an underlying future land use designation of Restricted Commercial. 42365375;1 Page 2 of 6 July 20, 2017 For the reasons stated herein, the Applicant respectfully submits through the Hearing Boards Division the following companion applications pursuant to Miami 21, Article 7.1.2.8, including all of the required and supplemental materials and documentation enclosed herein (the "Application"): (1) Rezoning. Request to rezone the North Parcels from T3-0 to T4 -L; and South Parcels from T4 -L to T5 -L; (2) FLUM Amendment. Request to amend the future land use map designation for the North Parcels to Medium Density Restricted Commercial (with no change to the South Parcels, which are already designated Medium Density Restricted Commercial), Description of Propedyl Existing Conditions The area was originally platted in conjunction with the Wynwood Neighborhood Revitalization District to the south, and became a largely working class Puerto -Rican neighborhood including workers from the textile industry and other jobs nearby. The Subject Properties today include a mix of residential building typologies, including multi -family apartment buildings, triplexes, duplexes, and a couple of single-family homes with accessory dwelling units, as well as certain vacant parcels. The parcel located at 3040 NW 21111 Avenue fronting on NW 315' Street is improved with a two-story commercial structure and surface parking lot.2 The majority of existing structures are aging, and nonconforming with current zoning and development standards under Miami 21. Many of the structures exceed the density under current zoning map classifications. The Subject Properties are abutting on the far eastern portion of the block existing multi -story commercial structures consisting of neighborhood -oriented commercial, including retail and office uses — which continues along both sides of the NW 2nd Avenue corridor. The area benefits from several large and established civic and institutional uses within a short walking distance, including Eneida Hartner Elementary School between NW 291h Street and 3011 Street, Jose de Diego Middle School on the west side of NW 5th Avenue, the Young Men's Preparatory Academy on the east side of NW 2nd Avenue, and Roberto Clemente Park further north on NW 2nd Avenue. The Subject Properties are located in close proximity and with good access by foot, bike, car, or transit to Miami's most dense, mixed-use and dynamic neighborhoods. There are several public transportation connection points within a short walking distance. North Miami Avenue and NW 2nd Avenue are both identified as critical Transit Corridors with increased trolley and bus routes, and there is actually a trolley and bus stop on the block comprised of the Subject Properties at NW 2nd Avenue. Midtown, within a short distance to the east, is anticipated within the SFRTA's service expansion plans as a site for a future connection point to commuter rail service and ancillary station area development, ... and a short walk down NW 2nd Avenue brings you to into the burgeoning Wynwood Arts District — restaurants, shopping and a number of new office buildings under development. The Design District is about 8 blocks north; Edgewater, Allappattah, Overtown, Omni all accessible within minutes. Despite the redevelopment of Buena Vista Yards into a now -thriving Midtown, and the revitalization and continued growth of the Wynwood Arts District, the neighborhood around the Subject Properties has experienced disinvestment over the years and decay in existing building stock, a trend towards short—term rentals while at same time rising land values and a demand for more housing options and supply. In the immediate area including the Subject Properties, there are fewer owner - occupied units; and many long-time residents have moved away from the neighborhood. 2 Note that the parcel located at 3040 NW 2"d Avenue, owned in its entirety by the Applicant, is identified with one single folia and property address, but with split zoning. The current zoning of the eastern portion fronting on NW 2nd Avenue is T5-0, while the western portion is T3-0. It is only the western porton that is included in the legal description for the Subject Properties and included in this Application, 42365375;1 Page 3 of 6 July 20, 2017 Background on Applicant; Reasons for Application. The Applicant, an affiliate of Westdale Real Estate and Investment Management, based in Dallas, TX, acquired the Subject Properties with the intention of redeveloping as a multifamily residential project with ancillary commercial uses along NW 2nd Avenue, and in a manner that is compatible with the existing neighborhood to the north but also reflecting the evolution and growth within the neighborhood already underway. Westdale has over 25 years owning, operating and developing real estate in urban neighborhoods — including today In 30 cities across the country, including Florida, and excited about the authenticity and spirit of embracing new residents in the Wynwood Residential District. We have had a number of preliminary meetings with Planning Department staff to ask questions and gather feedback on concerns about the neighborhood. For example, the initial request was intended to be for the South Parcels to be rezoned to T5-0, consistent with contiguous properties along NW 2nd Avenue. In doing the research and working with staff, we identified a potential concern throughout the Wynwood Residential District about commercial encroachment and negative impacts on the primary residential character in the area. The Application thus reflects a rezoning to T5 -L, recognizing the importance of maintaining and enhancing the residential character, as it limits commercial uses to ground floor which could be very appropriate along NW 301h Street to help activate the street. In starting to plan for future redevebpment, the Appiicant engaged Mr. Cesar Garcia -Pons AICP at Perkins + Will to study the existing conditions in this Wynwood Residential District and the requested Rezoning and Future Land Use Designation as to compatibility with the surrounding neighborhood. Mr. Garcia -Pons is a certified professionai planner and expert in urban planning with significant years of experience working in Miami, including for the Downtown Development Authority and also as Deputy Director of City of Miami Planning Department, The resulting Site Analysis Study and Report provides findings and recommendations supporting the Application and is included in the supporting materials enclosed herein and is referenced where appropriate in this letter of intent. Current zoning is out of sync with existing conditions and inadequate to position the area as a walkable, transit -oriented and accessible neighborhood for existing & future residents. 1. The existing density on the Subject Properties today already exceeds the maximum density permitted by the underlying zoning. For example, on the South Parcels, one of the apartment buildings (269 NW 301' Street), is slightly less than 50 units/acre; 2. With current land prices and under the current zoning for the Subject Properties (restricting density to 18-36 units/acre under T3 and T4, respectively), recent residential development in the immediate area has been limited to large footprint attached dwellings or townhomes, which could actually lead to net loss of residential dwelling units if the pattern continues;3 3. Despite City's policies creating incentives for a mix of attainable housing options, current zoning virtually ensures no new attainable housing developed in this area, and is likely to result in ad hoc demolitions of existing aging non -conforming structures;' and 4. Current zoning negatively impacts the ability to make any commercial site improvements or develop the adjacent T5-0 properties along NW 2"d Avenue because of the current abrupt transition from T5-0 to T3-0 on the North Parcels, 3 Current density would permit a maximum residential capacity of 30 units on the North Parcels and 60 units on the South Parcels 4 Any displacement effect would likely be caused by the current zoning of the subject properties. 42365375;1 Page 4 of 6 July 20, 2017 Intended Concept Plan for Residential Development. Westdaie's intent is to create a multi- family residential project that brings a significant injection of additional dwelling units into the neighborhood and developing new and attractive housing options for both existing and new residents wanting to live in this neighborhood already defined by mature tree canopy and proximity to surrounding schools and other amenities of Midtown and Wynwood. As demonstrated in the Site Analysis Study and Report, the existing densities in the neighborhood alone merit the proposed rezoning and future land use designations. Existing buildings in T3 and T4 zones on surrounding blocks to the north and west range widely up to 119 units/acre. Other neighborhoods nearby range in density exceeding 150 u/acre (Wynwood NRD-1) to 500 a/acre (Omni). Evaluating the site and surrounding conditions and considering the investment made in the acquisition, this Application - to T4 -L for the North Parcels and T5 -L on the South Parcels — is clearly critical to establishing an appropriate baseline for redevelopment in the area, Westdale would not be able to achieve a meaningful project without it, Positive Contribution to the Fabric and Character of the Neighborhood. The existing housing stock is aging, with many buildings structurally deficient; current tenants are not long-time residents. Westdale's intent is to spark a sensible and contextual approach to improvements in the neighborhood, in a way that (A) maintains primary residential character, (B) adds significantly to the total housing supply & quality of housing on the block and in the neighborhood and to support local businesses and schools in the neighborhood, and (C) opportunity for unified site development plan for the entire block for best practices implementation and enhance the urban design. 1. Rezoning to T4 -L and T5 -L refiects intent to preserve and enhance primary residential character; Future Land Use Designation of North Parcels to Medium Density Restricted Commercial consolidates the North Parcels and South Parcels and is consistent with the block immediately to the west. 2. Increase in housing stock to support businesses, schools and residents in the area looking for quality housing. Under current zoning for North Parcels and South Parcels Applicant could develop a total of 91 Dwelling Units. Under the proposed zoning for North Parcels and South Parcels, Applicant coub develop a total of 171 Dwelling Units. 3. Although there is no set of architectural/site plans for the future project and Westdale is still considering the mix of units and number of buildings, in this case, the future project will require an Exception due to the size of the assemblage and redevelopment site exceeding the maximum lot size in T4 -L and T5 -L, and thus staff and the community will have a full opportunity to vet the project prior to site plan approval and obtaining building permits. Ownership over entire bock creates frontage buffers from other neighbors in the area; no immediate neighbors that are directly impacted by the rezoning or future development. Merits for Approval of the Future Land Use Amendment/ MCNP The Future Land Use Amendment relates to the North Parcels, as Medium Density Restricted Commercial. First, this is consistent with the South Parcels and unifies the future development site. Second, this is consistent with the entire block immediately to the west. Lastly, it would be reflective of liberalizing density but also understanding that the zoning classification would practically limit development and uses even further to provide an appropriate transition to the north. 42355375:1 Page 5 of 0 July 20, 2017 Merits for Approval of the Rezoning under Article 7.1.2.8 of Miami The proposed rezoning meets all of the technical threshold criteria in Article 7, Section 7.1.2.8 of Miami 21, sufficient to warrant a zoning referral from the Office of Zoning to submit this Application. o The proposed rezoning of both the South Parcels and North Parcels, as identified herein, meets requirement of successional zoning as set forth under Miami 21, Article 7, Section 7.1.2.8.a.3. o With respect to the South Parcels, the proposed rezoning from T4 -L to T5 -L meets the threshold criteria under Miami 21, Article 7, Section 7.1.2.8.c, because the request is for an extension of the existing T5 boundary to the east. Additionally, this criteria is met because the request involves more than 40,000 square feet of land area and more than 200 feet of frontage on NW 3011 Street. o With respect to the North Parcels, the proposed rezoning from T3-0 to T4 -L meets the necessary criteria under Miami 21, Article 7, Section 7.1.2.8.c, because the request involves more than 40,000 square feet of land area and more than 200 feet of frontage on NW 311 Street, Furthermore, it reflects an extension and consistency with the existing zoning atlas designation for the properties west of NW 311 Avenue. The Site Analysis Study and Report included provides an analysis of the properties within the surrounding neighborhood 1/2 mile radius of Subject Properties. As demonstrated in the Site Analysis Study and Report and as set forth herein, current zoning does not reflect existing conditions on the Subject Properties nor in surrounding neighborhood. Densities are already largely non -conforming exceeding current zoning. It is a neighborhood that is being hindered by its current zoning and not allowing for new housing stock to be built. Conversely, the proposed zoning would allow for significant additional housing stock to help satisfy that demand and allow for range of units at smaller and larger sizes. The proposed zoning is more in line with the current and future densities appropriate for the neighborhood. A recent change in conditions that is meaningful is the City's designation of North Miami Avenue and NW 2nd Avenue as Transit Corridors, That means the headway times have increased significantly and should be reflected in future development patterns within the '/4 mile walking radius, typically synonymous with transit- oriented development (increased density, parking flexibilities, etc). Finally, as shown in the massing diagram included at the end of the Site Analysis Study and Report, the Application proposes to maintain appropriate & compatible transitions in intensity in line with transect goals of Miami 21 with respect to properties immediately to the north, south, east, and west. Community Outreach and Dialogue Applicant has already spent considerable time on the ground in the neighborhood really getting an understanding of the area and hired one of the former owners of the properties, to stay on and manage the rental properties and make sure that the Applicant is aware and attentive to the surrounding neighborhood. They've been very forthright with new tenants about potential redevelopment in the future. They have renovated and fixed up several of the properties and cleared out a number of violations inherited from previous owners, to be good stewards of the neighborhood as best they can, 42365375;[ Page 6 of 6 July 20, 2017 We have met with School Board officials to discuss the Subject Properties in context with the neighborhood and status of enrollment in the local area schools and have kept an open dialogue; Applicant has also reached out to a number of property owners in the area and has spent significant amount on site in the neighborhood observing traffic patterns and talking with neighbors. We will continue to take this proactive approach to advancing community dialogue through the public hearing process. Conclusion The Subject Properties present a unique and important redevelopment opportunity in the area, especially given its location, size, continuity, frontages, and dose proximity to the NRD-1 boundaries, Midtown, and key transportation corridors. The proposed Application reflects upon existing and future land use trends in the area to provide Applicant with a better baseline for a unified development for the block and a multi-famiiy residential program at more appropriate densities contributing to new housing stock in the area; meaning in turn more housing opportunities for a broad mix of people - working families, young professionals, and building the critical mass of residents needed to support and complement existing schools and neighborhood -oriented commercial uses along NW 2"d Avenue. For the foregoing reasons, we respectfuliy request a favorable recommendation on the Application prior to scheduling in front of Planning Zoning and Appeals Board. Analysis The block/parcels in this analysis (hereby referred to as the site) are located in an aging, transitional neighborhood located immediately north of the recently approved Wynwood Neighborhood Revitalization District, two blocks west of the established Midtown Miami mixed-use development, and east and south of 1-95 and 1- 195, respectively. The parcels/uses adjacent to the site include: to the East: one and two-story retail establishments along the west side and two-story Young Men's Preparatory Academy and M Building commercial event space on the east side of NW 2nd Avenue (a major north/south mixed-use retail corridor connecting EI Portal to the north, traversing Little River, Little Haiti, Wynwood, Overtown, Downtown, and culminating in Brickell to the south). to the South: one, two and three-story educational, commercial and residential uses — Elena M. As noted in the analysis, the site is nestled amongst the various mixed -uses and multiple building heights as identified above and the existing one-story single family residences are no longer in scale or compatible in character with the existing buildings or current uses to their immediate east, south and west. Also this site is uniquely located to provide an opportunity to support and protect the residential character of the neighborhood to the north by providing additional, improved quality residential alternatives in a transitional "townhouse" style buffer between the proposed higher density and existing higher intensity uses. A rezoning of the parcels along NW 30th Street would be better served as T5 -L (Urban Center Transect Zone Limited) instead of T4 -L in order to create a transitional zone and help mitigate the scale and character of the immediate T5-0 uses (retail) to the east and Cl/T5-0 uses (school, commercial and senior center) and the eight to twelve story mixed-use character of NW 29th Street and the Wynwood Commercial Area just one block to the south. A rezoning of the parcels along NW 31st Street would be better served as T4 -L (General Urban Transect Zone Limited) instead of T3-0 in order to increase the amount of new quality residential alternatives and create a transitional zone to help mitigate the scale and character of the immediate T5-0 uses (retail) to the east and the T4 use (4 story senior housing complex) to the west.
