City of Miami File ID: 3675 (Revision: A) Printed On: 7/9/2018 File Number: 3675 City of Miami Legislation Ordinance Enactment Number: 13750 Final Action Date: 3/22/2018 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING CHAPTER 1 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "GENERAL PROVISIONS," MORE PARTICULARLY BY ADDING NEW SECTION 1-16 TO DESIGNATE THE OFFICIAL SEAL OF THE CITY OF MIAMI IN ACCORDANCE WITH SECTION 165.043, FLORIDA STATUTES, AND TO ESTABLISH REGULATIONS RELATED TO THE USE OF THE SEAL; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 165.043, Florida Statutes, authorizes the governing body of a municipality, by ordinance, to designate an official municipal seal and prohibits the unauthorized use, manufacture, display, or other employment of any facsimile or reproduction of the municipal seal, except by municipal officials or employees in the performance of their official duties, without the express written approval of the governing body; and WHEREAS, the City of Miami ("City") is built on culture, history, and preservation and wishes to designate and establish regulations relating to the use of its official seal to facilitate its unique brand of the City; and WHEREAS, on July 28, 1896, the City adopted the corporate seal of the City that was described as follows: a round seal two (2) inches in diameter with the words "The City of Miami" arranged in a semi -circular form, constituting the border around the base and the design of the Royal Palm Tree in an upright position in the center of the seal, with the inscription, "Incorporated 1896;" and WHEREAS, such similar design has been used in the City since 1896; and WHEREAS, the City Commission wishes to continue to use the design as described herein as the official seal of the City: WHEREAS, the official seal of the City is also attached, herein as Exhibit "A"; and City of Miami File ID: 3675 (Revision: A) Printed On: 7/9/2018 WHEREAS, all seals previously used or adopted by the City are solely reserved for use by the City, its agencies, and instrumentalities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 1 of the Code of the City of Miami, Florida, as amended, is further amended by adding a section to be numbered Section 1-16, which section reads as follows:' "CHAPTER 1 GENERAL PROVISIONS Sec. 1-16. City Seal. A. City Seal: As used herein, the City seal shall mean the graphical seal as depicted below and comprised of a round seal with the words "The City of Miami" and "Florida" arranged in a semicircular form, constituting the border and the design of the Royal Palm Tree in an upright position in the center of the seal, with the inscription "Incorporated 1896" inserted must below the center of the seal. Said City Seal shall be the official seal of the Citv. I N C 0 R P 0RAiE0 f] R 1 B. Unauthorized Use of the City Seal: It shall be unlawful and a violation of this Section to manufacture, use, display, or otherwise employ any facsimile or reproduction of the City Seal, except by City officials or employees in their official duties, without the express approval of the City Commission. Such unauthorized use shall constitute a violation of this Section and may be punished by a court of competent jurisdiction up to the maximum penalty permitted by law as provided by Section 1-13 of this Code and Florida Statute 165.043. C. All seals previously used or adopted by the City are solely reserved for use by the City, its agencies, and instrumentalities, which shall maintain all rights authorized and provided for pursuant to Florida Statute 165.043." The City, its agencies, and instrumentalities retain all rights to the continued use of all seals previously used or adopted by the City until it deems fit. Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5.
