Purpose of Item:
It is respectfully recommended that the Miami City Commission adopt the attached
resolution, by a four-fifths (4/5ths) affirmative vote, ratifying, confirming and approving
the City Manager's written finding of an emergency, waiving competitive sealed bidding
procedures and retroactively approving the selection of Grupo InPower, LLC for the
emergency installation, and replacement of the Uninterrupted Power Supply (UPS)
System for the Police Department (Police), for a purchase amount of $43,720.00.
Background of Item:
Police has been tasked with replacing the UPS system at the Fire College that is
beyond repair. The Fire College houses the back-up communication systems for police,
fire, and Emergency 911 (E911). It is of vital importance that the Fire College has a
functioning UPS system in case there is a dire need for relocation of the Fire
Department, Police Department, and E911 dispatch centers, from the Police
headquarters building. Without a working UPS system, there is a potential for power
outages at the Fire College which will damage the Computer Aided Dispatch (CAD)
Server that could ultimately impact the E911 phones and back-up the First -in Alerting
System. It is imperative that the City of Miami's Fire and Police departments be able to
operate at all times in order to provide access to public service to the community in
which they serve.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR-FIFTHS (4/5) AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND
CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED AND
INCORPORATED AS EXHIBIT "A", THAT IT IS MOST ADVANTAGEOUS FOR THE
CITY OF MIAMI TO WAIVE COMPETITIVE SEALED BIDDING PROCEDURES,
PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA;
RETROACTIVELY APPROVING THE SELECTION OF GRUPO INPOWER, LLC FOR
THE INSTALLATION AND REPLACEMENT OF THE UNINTERRUPTED POWER
SUPPLY SYSTEM FOR AN AMOUNT NOT TO EXCEED $43,720.00.
WHEREAS, the City of Miami's ("City") Fire -Rescue and Police Departments require the
replacement of the back-up Uninterrupted Power Supply ("UPS") System for the Fire College,
which houses the back-up communications system for the Police Department, Fire -Rescue
Department, and Emergency 911 ("E911 ") system; and
WHEREAS, it is of vital importance that the Fire College has a functioning UPS system
in the event there is a need for the relocation of the Fire -Rescue Department, Police
Department, and E911 dispatch centers from the Police headquarters building; and
WHEREAS, the user department submitted to the Chief Procurement Officer and the
City Manager a full explanation of the emergency and other information as provided in Section
18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), attached and
incorporated as Exhibit "A"; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the City Code, approved an
emergency bid waiver for the installation and replacement of the back-up UPS system at the
Fire College;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, the City Manager's emergency
finding, attached and incorporated as Exhibit "A", that it is most advantageous for the City to
waive the competitive sealed bidding procedures, pursuant to Section 18-90 of the City Code,
retroactively approving the selection of Grupo InPower, LLC, for the installation and
replacement of the UPS system at the Fire College for an amount not to exceed $43,720.00, is
ratified, approved, and confirmed.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
