HomeMy WebLinkAboutR-18-0117City of Miami Legislation Resolution: R-18-0117 File Number: 3816 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 3/8/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE NOISE PROHIBITIONS OF SECTION 36-4(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), ENTITLED "OPERATION OF RADIOS, PHONOGRAPHS OR OTHER SOUND -MAKING DEVICES; BANDS, ORCHESTRAS AND MUSICIANS — GENERALLY; EXEMPTION," AND SECTION 36-5(A) OF THE CITY CODE, ENTITLED "SAME — HOURS OF OPERATION OF JUKEBOXES RADIOS, ETC.; EXEMPTION FOR EVENTS ON CITY OWNED PROPERTY; RELAXATION," FOR WINTER MUSIC CONFERENCE RELATED EVENTS IN THE WYNWOOD NEIGHBORHOOD OF MIAMI, FLORIDA, MORE SPECIFICALLY, THE AREA SOUTH OF NORTHWEST 29 STREET, NORTH OF NORTHWEST 20 STREET, WEST OF NORTH MIAMI AVENUE AND EAST OF NORTHWEST 6 AVENUE, TO BE HELD MARCH 22, 2018 THROUGH MARCH 25, 2018. WHEREAS, Section 36-4(a) of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits excessive noise or music audible at a distance of one hundred (100) feet from a building, structure, or vehicles from where the noise is produced; and WHEREAS, Section 36-4(b) of the City Code provides that the City Commission may waive the provisions of Section 36-4(a) for special occasions by Resolution; and WHEREAS, Section 36-5(a) of the City Code prohibits excessive noise or music audible being played in a closed building to be audible outside the building so as to disturb the quiet, comfort, and repose of persons in any dwelling, hotel, or other type of residence between the hours of 11:00 p.m. and 7:00 a.m.; and WHEREAS, Section 36-5(c) of the City Code provides that the City Commission may relax the provisions of Section 36-5(a) for special occasions by Resolution; and WHEREAS, Winter Music Conference, Miami Music Week, and Ultra Music Festival ("Winter Music Conference") are six (6) day music and industry -related events, conferences, concerts, and other events that takes place all over Miami -Dade County each year; and WHEREAS, Winter Music Conference is scheduled to be held from March 20, 2018 through March 25, 2018; and WHEREAS, accompanying the main events are special events where there will be large gatherings of persons and entertainment will be provided; and WHEREAS, Winter Music Conference attracts people from all over the world to listen to and participate in the music events and it is also a forum to showcase local talent which is a benefit to the residents of the City of Miami; City of Miami Page 1 of 2 File ID: 3816 (Revision:) Printed On: 7/3/2018 File ID: 3816 Enactment Number: R-18-0117 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The noise prohibitions contained in Section 36-4(a) of the City Code are waived pursuant to Section 36-4(b) of the City Code, entitled "Operation of radios, phonographs or other sound -making devices; bands, orchestras and musicians—Generally; exemption," and Section 36-5(a) of the City Code is relaxed pursuant to Section 36-5(b) of the City Code, entitled, "Same — Hours of operation of jukeboxes radios, etc.; exemption for events on city owned property; relaxation," for Winter Music Conference related events in the Wynwood neighborhood of Miami, Florida, more specifically, the area South of Northwest 29 Street, North of Northwest 20 Street, West of North Miami Avenue, and East of Northwest 6 Avenue to be held March 22, 2018 through March 25, 2018. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
