HomeMy WebLinkAboutR-16-0604City of Miami Legislation Resolution: R-16-0604 File Number: 1377 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE MAYOR'S SHARE OF THE CITY OF MIAMI'S ("CITY'S") ANTI -POVERTY INITIATIVE, IN A TOTAL AMOUNT NOT TO EXCEED $10,000.00, TO COMMON THREADS INCORPORATED, TO PROVIDE COOKING EDUCATION PROGRAMS TO CITY RESIDENTS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Tomas Regalado WHEREAS, pursuant to Resolution No. 14-0362, adopted September 23, 2014, at a public hearing, the City Commission approved an allocation of funds in the amount of $1.25 million for the newly created City of Miami ("City") Anti -Poverty Initiative; and WHEREAS, Common Threads Incorporated assists City youth with cooking and nutritional education; and WHEREAS, the Mayor wishes to grant funds from the Mayor's share of the City's Anti - Poverty Initiative, in an amount not to exceed $10,000.00 ("Funds"), to assist City youth with learning proper nutrition and cooking skills ("Program"); and WHEREAS, the City Manager has made a written determination, attached and incorporated as Exhibit "A", pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), that competitive bidding is not practicable or advantageous for the City; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute an agreement for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manger's written determination, attached and incorporated as Exhibit "A", finding that competitive negotiation methods and procedures are not practicable or advantageous to the City of Miami Page 1 of 2 File ID: 1377 (Revision: 8) Printed On: 6/25/2018 File ID: 1377 Enactment Number: R-16-0604 City pursuant to Section 18-85(a) of the City Code and waiving the requirements for said procedures is ratified, approved and confirmed. Section 3. The City Manager is authorized' to allocate grant funds from the Mayor's share of the City's Anti -Poverty Initiative, to Common Threads Incorporated, in an amount not to exceed $10,000.00. Section 4. The City Manager is authorized' to execute any and all necessary documents, in a form acceptable to the City Attorney, to effectuate the Program. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i "ndez, City Attor ey 11/29/2016 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
