HomeMy WebLinkAboutR-16-0596City of Miami Legislation Resolution: R-16-0596 File Number: 1150 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROCUREMENT OF REMOUNTING SERVICES FOR THE FIRE -RESCUE DEPARTMENT, FROM TEN -8 FIRE EQUIPMENT, INC., THE SOLE AUTHORIZED DEALER AND SERVICE FACILITY IN THE STATE OF FLORIDA FOR BRAUN INDUSTRIES, INC., THE MANUFACTURER OF REFURBISHED PATIENT COMPARTMENT MODULES FOR AMBULANCES, FOR AN ESTIMATED AMOUNT OF $170,000.00 PER EMERGENCY MEDICAL TRANSPORT VEHICLE MODULE REMOUNTING, ALLOCATING FUNDS FROM USER DEPARTMENTS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO EXECUTE THE PROFESSIONAL SERVICES AGREEMENT ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS AND MODIFICATIONS TO THE PSA, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that Ten -8 Fire Equipment, Inc. ("Ten -8") is the sole authorized dealer and service facility in the State of Florida for Braun Industries, Inc. ("Braun"), the manufacturer of refurbished patient compartment modules for ambulances, which when removed, refurbished and reattached to the chassis and cab, extends the life of an ambulance, maintains all quality standards, and realizes a forty to fifty percent (40%/50%) savings over the price of a new ambulance; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and that the procurement of the above services, as specified, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended, after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the procurement of Braun remounting services for the Fire -Rescue Department, Ten -8, the sole authorized dealer and service facility in the State of Florida for Braun, the manufacturer of refurbished patient compartment modules for ambulances, is approved. Section 3. Funds to be allocated from the User Departments, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to execute the Professional Services Agreenet, in substantially the attached form, with Ten -8, the sole authorized dealer and service facility in the State of Florida for Braun, the manufacturer of refurbished patient compartment modules for ambulances, as identified in Exhibit "A". Section 5. The City Manager is further authorized' to negotiate and execute all other documents, including any amendments, renewals and modifications to the contract, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: +rey i riai ' ndez, City At11/21/2016 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 This Resolution shall become effective as specified herein unless vetoed by Mayor with ten (10) days from the date it was passed and adopted.
