HomeMy WebLinkAboutR-16-0569City of Miami Legislation Resolution: R-16-0569 File Number: 1161 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 12/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE PROPOSALS RECEIVED JUNE 6, 2016, FROM VARIOUS TOWING AGENCIES AS IDENTIFIED IN EXHIBIT "A", ATTACHED AND INCORPORATED, PURSUANT TO REQUEST FOR QUALIFICATIONS ("RFQ") NO. 612382, FOR CITYWIDE TOWING SERVICES; AUTHORIZING THE CITY MANAGER TO EXECUTE TOWINGM/RECKER AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE QUALIFIED RESPONSIVE AND RESPONSIBLE TOWING AGENCIES FOR SAID SERVICES, FOR AN INITIAL CONTRACT PERIOD OF FIVE (5) YEARS WITH THE OPTION TO RENEW FOR ONE (1) ADDITIONAL FIVE (5) YEAR PERIOD; FURTHER AUTHORIZING THE CITY MANAGER, IN ACCORDANCE WITH THE RFQ, THE ABILITY TO ADD QUALIFIED TOWING AGENCIES TO THE CONTRACT WHEN DEEMED IN THE BEST INTEREST OF THE CITY WITHOUT FURTHER CITY COMMISSION AUTHORIZATION; AND FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND MODIFICATIONS TO THE AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") issued Request for Qualifications ("RFQ") No. 612382 to establish contracts for Citywide towing services based on five (5) established geographical Zones within the City; and WHEREAS, the proposals received June 6, 2016, pursuant to RFQ No. 612382, from qualified towing agencies, for Citywide towing services and as identified in Exhibit "A", attached and incorporated, have been deemed qualified by the City; and WHEREAS, the City successfully negotiated with all five (5) towing agencies, who have signed the agreements; and WHEREAS, the City will execute agreements with the five (5) qualified responsive and responsible towing agencies; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The proposals received on June 6, 2016, from various responsive and responsible proposers pursuant to RFQ No. 612382, for Citywide towing services, as identified in Exhibit "A", attached and incorporated, for an initial contract period of five (5) years, with one (1) additional five (5) year option to renew period, are accepted and deemed qualified. The City Manager is authorized' to add additional qualified towing agencies to the contract without further City Commission Authorization, as deemed in the best interest of the City. Section 4. The City Manager is authorized' to execute Towing/Wrecker Agreements, in substantially the attached form, with the qualified responsive and responsible towing agencies for said services. Section 5. The City Manager is further authorized' to negotiate and execute all other documents, including any amendments, renewals and modifications to the contract, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: l Una ndeU�z,ty Httor iey 11/7/2016 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 This Resolution shall become effective as specified herein unless vetoed by Mayor with ten (10) days from the date it was passed and adopted.
