A RESOLUTION OF THE MIAMI CITY COMMISSION OPPOSING THE
AMENDMENT 1 BALLOT QUESTION TITLED "RIGHTS OF ELECTRICITY
CONSUMERS REGARDING SOLAR ENERGY CHOICE", SCHEDULED FOR
NOVEMBER 8, 2016 GENERAL ELECTION BALLOT.

WHEREAS, Amendment 1, entitled "Rights of Electricity Consumers Regarding Solar
Energy Choice," will be presented to voters at the November 8, 2016 general election; and
WHEREAS, Amendment 1 purports to prohibit the subsidization of those who install
solar panels on rooftops by those who do not; and
WHEREAS, passage of Amendment 1 will misleadingly deem those rooftop solar panel
customers to be subsidized by other utility ratepayers because the cost of maintaining the
ancillary infrastructure appurtenant to an electrical distribution system would be borne by other
users; and
WHEREAS, this will curtail the ability to lease solar equipment from third -party vendors,
the net effect of which would be the greater use of solar energy as a renewable resource in
Florida; and
WHEREAS, Amendment 1 will additionally curtail utilities' net metering programs
whereby rooftop solar panel customers are given a credit for solar energy generated on-site
against energy purchased by the utility in the normal course and scope of its business; and
WHEREAS, the dissenting opinion in Advisory Opinion to Atty. Gen. re Rights of
Electricity Consumers regarding Solar Energy Choice, 188 So.3d 822 (Fla. 2016) notes that
Amendment 1 will curtail the rights of consumers and creates broad discretion to do so through
an expansive reading of the term "subsidize"; and
WHEREAS, the net effect of the passage of Amendment 1 will be the slower growth, and
possible diminishment of solar energy generation in the State of Florida;
NOW, THEREFORE, BE IT RESOLVED, BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby opposes the passage of Amendment 1 and
urges the voters of the City of Miami to vote no on said ballot question.

Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

' If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
