HomeMy WebLinkAboutR-16-0450Vop City of Miami Legislation < U R �O Resolution: R-16-0450 File Number: 16-01265 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/22/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED: "WAGNER CREEK/SEYBOLD CANAL DREDGING/RESTORATION PROJECT"; AUTHORIZING THE CITY MANAGER TO ACCEPT AN ADDITIONAL LEGISLATIVE APPROPRIATION REIMBURSEMENT GRANT AWARD AND TO APPROPRIATE FUNDS, IN AN AMOUNT NOT TO EXCEED $250,000.00 ("GRANT"), FROM THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION ("FDEP"), FOR THE WAGNER CREEK/SEYBOLD CANAL DREDGING/RESTORATION PROJECT ("PROJECT"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE FDEP AGREEMENT NO. S0774, AMENDMENT NO. 2, ("SECOND AMENDED AWARD AGREEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND ANY AMENDMENTS, MODIFICATIONS, EXTENSIONS, OR RENEWALS THEREOF, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO ACCEPT THE GRANT, TO COMPLY WITH THE SECOND AMENDED AWARD AGREEMENT, AND TO IMPLEMENT THE PROJECT. WHEREAS, through an appropriation by the Florida Legislature in the 2016-2017 General Appropriations Act under Line Item 1600A, the City of Miami ("City") has been awarded a legislative appropriation reimbursement grant from the State of Florida Department of Environmental Protection ("FDEP"), in an amount not to exceed $250,000.00 ("Grant"), to implement the Wagner Creek/Seybold Canal Dredging/Restoration Project ("Project"); and WHEREAS, previously the City has received an earlier legislative appropriation reimbursement grant through FDEP, the City and FDEP amended the earlier grant agreement to reflect updates in the Project, and the City and FDEP now desire to amend further the earlier grant agreement by executing FDEP Agreement No. S0774, Amendment No. 2 ("Second Amended Award Agreement") in order to add the new Grant and to further update the timeline for the Project; and WHEREAS, the City Commission has previously endorsed the Project by funding and permitting the design, and the Florida Inland Navigation District has previously awarded three (3) grants to the City totaling $3.7 million toward the navigable portion of the Project; and WHEREAS, the City has a strong interest in the marine industrial businesses and residential navigational access in the Project areas, and the dredging and restoration will allow twenty-four (24) hour maritime access for the Seybold Canal which will increase economic benefits to the City; and WHEREAS, the Project will improve the environment and promote health by reducing decades of materials collecting in the Wagner Creek/Seybold Canal, some of which flow into the Miami River and Biscayne Bay, Miami, Florida; and WHEREAS, it is appropriate for the City Manager to accept the Grant, to establish a new City of Miand Page 1 of 2 File Id. 16-01265 (Version: 1) Printed On: 5/29/2018 File Number: 16-01265 EnactmentNnmber: R-16-0450 special revenue project fund for the appropriation of the Grant, and to negotiate and execute, in a form acceptable to the City Attorney, the Second Amended Award Agreement with FDEP; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The following new Special Revenue Fund is established and resources are appropriated as described below: FUND TITLE: Wagner Creek/Seybold Canal Dredging/ Restoration Project RESOURCES: State of Florida, Department of $250,000.00 Environmental Protection APPROPRIATIONS: Complete the Wagner Creek/Seybold $250,000.00 Canal Dredging/Restoration Project Section 3. The City Manager is authorized{1} to accept a legislative appropriation reimbursement Grant award and to appropriate funds, in an amount not to exceed $250,000.00, from the FDEP, for the Project. Section 4. The City Manager is further authorized{1 } to negotiate and execute the Second Amended Award Agreement, in a form acceptable to the City Attorney, and any amendments, modifications, extensions, or renewals thereof, in a form acceptable to the City Attorney, in order to accept the Grant, to comply with the Second Amended Award Agreement, and to implement the Project. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
