A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO ALLOW THE PLANTING OF COCONUT PALM TREES (COCOS
NUCIFERA) AND ROYAL PALM TREES (ROYSTONEA REGIA) IN THE PUBLIC
RIGHT-OF-WAY ON THE SAME OR SIMILAR BASIS AS 01 -HER TREE SPECIES
FOUND IN THE MIAMI-DADE COUNTY LANDSCAPE MANUAL CONSISTENT
WITH CHAPTER 17 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AND
CHAPTER 18A OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, the City of Miami Administration has discouraged the planting of Coconut Palms
and Royal Palms in the City of Miami ("City") due to a perceived safety hazard to both people and
property; and
WHEREAS, the Code of Miami -Dade County, Florida, as amended ("County Code"), does not
prohibit the planting of Coconut Palms or Royal Palms; and
WHEREAS, Chapter 17 of the Code of the City of Miami, Florida, as amended ("City Code"),
defines "Prohibited Tree Species" as "those tree species that are detrimental to native plants, native
wildlife, ecosystems, and human health, safety or welfare. Prohibited tree species includes those
designated as such in the Miami -Dade County Landscape Manual and the Ficus Benjamina/Weeping
Fig"; and
WHEREAS, the Miami 21 Code, the Zoning Ordinance of the City of Miami, as amended,
defines "Prohibited plant species" as "Those plant species listed in the Miami -Dade County Landscape
Manual which are demonstrably detrimental to native plants, native wildlife, ecosystems, or human
health, safety, and welfare"; and
WHEREAS, the Miami -Dade County Landscape Manual lists Coconut Palms under the "Palms
and Cycads" section and lists the Royal Palm as drought -resistant; and
WHEREAS, the City Commission deems Coconut Palms and Royal Palms not to be
"detrimental to native plants, native wildlife, ecosystems, and human health, safety or welfare"; and
WHEREAS, the City Commission wishes to allow the City to plant Coconut and Royal Palms in
the public Right -of -Way consistent with Chapter 18A of the County Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission deems Coconut Palms and Royal Palms not to be
"detrimental to native plants, native wildlife, ecosystems, and human health, safety or welfare" and

directs the City Manager to allow the same to be planted on the same basis as other allowed tree
species in the public Right -of -Way consistent with Chapter 17 of the City Code and Chapter 18A of the
County Code.
Section 3 This Resolution shall become effective upon its adoption and signature of the

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
