HomeMy WebLinkAboutR-16-0405Vop City of Miami ' Legislation < U R �O Resolution: R-16-0405 File Number: 16-01098 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT AND APPROPRIATE GRANT FUNDS FROM THE STATE OF FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY, IN AN AMOUNT NOT TO EXCEED $750,000.00, TO FUND THE COST OF PUBLIC INFRASTRUCTURE AND RIGHT-OF-WAY IMPROVEMENTS WITHIN THE CITY OF MIAMI DESIGN DISTRICT ALONG NORTHEAST 41 ST STREET BETWEEN NORTHEAST 1 ST AVENUE TO NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, ASSOCIATED WITH THE CAPITAL IMPROVEMENTS AND TRANSPORTATION PROGRAM PROJECT NO. B-173600, "NE 41 ST STREET/DESIGN DISTRICT IMPROVEMENTS," FOR THE PERIOD FROM JULY 1, 2016 THROUGH JUNE 30, 2017; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND NEGOTIATE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID GRANT AGREEMENT, INA FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO INSTITUTE THE ACCEPTANCE, IMPLEMENTATION, AND ADMINISTRATION OF SAID GRANT. WHEREAS, the City of Miami ("City") will be constructing public infrastructure and right-of-way improvements within the City's Design District along Northeast 41 st Street between Northeast 1 st Avenue and Northeast 2nd Avenue, Miami, Florida ("Project"), associated with the Capital Improvements and Transportation Program ("CITP") Project No. B-173600, "NE 41st Street/Design District Improvements"; and WHEREAS, the scope of work for the Project consists of the installation of right-of-way improvements such as roadway utilities, which include drainage, water, sanitary, and gas in the right of way; pavers, which include concrete pavers as a permanent surface on sidewalks; street light fixtures, which include signals and signage; landscaping and irrigation; and site amenities, which inlcude bike racks and trash cans in the public right-of-way ("Work"); and WHEREAS, the Grant Agreement ("Agreement"), in substantially the attached form, between the State of Florida Department of Economic Opportunity ("DEO") and the City, provides funding to the City in an amount not to exceed $750,000.00 ("Grant Funds") for the period of July 1, 2016 through June 30, 2017, and requires a fifty percent (50%) City match in the form of a cash contribution or a capital project that benefits the area; and WHEREAS, the City elects to provide its match in the form of a capital project that benefits the area, specifically in enhancements to a Miami -Dade County owned public right-of-way along Northeast 2nd Avenue between Northeast 42nd Street and Northeast 51 st Street in the City's Design District ("CITP Project No. B-78508"); and WHEREAS, the Grant Funds from the DEO shall be used solely for costs associated with the Work for the Project; City of Miand Page 1 of 2 File Id. 16-01098 (Version: 1) Printed On: 5/24/2018 File Number: 16-01098 Enactment Number: R-16-0405 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to accept and appropriate Grant Funds in an amount not to exceed $750,000.00 from the DEO, to fund the cost of the Project. Section 3. The City has the ability and intention to finance its share of the Project costs in the form of a capital project that benefits the area, and has allocated funds in the amount of $375,000.00 from CITP Project No. B-78508. Section 4. The City Manager is further authorized {1 } to execute the Agreement between the DEO and the City, in substantially the attached form, and negotiate all other documents, including amendments and modifications thereto, in a form acceptable to the City Attorney, to institute the acceptance, implementation, and administration of said Grant for said purposes, for the period from July 1, 2016 through June 30, 2017. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
