A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
THE VILLAGE OF KEY BISCAYNE ("VILLAGE") TO PROVIDE FIRE RESCUE,
AUTOMATIC AID AND ANCILLARY SERVICES TO THE VILLAGE, FOR A PERIOD
OF FIVE (5) YEARS, COMMENCING OCTOBER 1, 2016 THROUGH SEPTEMBER
30, 2021.
WHEREAS, pursuant to Resolution No. 98-555, adopted June 9, 1998, the Village of Key
Biscayne ("Village") and the City of Miami ("City") entered into an Agreement to provide fire rescue,
automatic aid and ancillary services for the Village for a period of five (5) years commencing October
1, 1998 through September 30, 2003; and
WHEREAS, pursuant to Resolution No. 03-1053, adopted September 25, 2003, the City
entered into a First Amendment Agreement with the Village to extend the contract on a
month-to-month basis, not to exceed six (6) months, from October 1, 2003 through March 31, 2004, to
continue providing such services for the Village while the City's Department of Fire -Rescue negotiated
a new contract; and
WHEREAS, pursuant to Resolution No. 04-132, adopted March 1, 2004, the City entered into
an Agreement with the Village to provide fire rescue, automatic aid and ancillary services to the Village
for a period of five (5) years commencing on April 1, 2004 through March 31, 2009; and
WHEREAS, pursuant to Resolution No. 10-0100, adopted March 11, 2010, the City entered
into an Agreement with the Village to provide fire rescue, automatic aid and ancillary services to the
Village for a period of five (5) years commencing on April 1, 2010 through March 31, 2015; and
WHEREAS, the City and the Village have found this to be a mutually beneficial relationship,
and both parties have met all obligations of the previous contract; and
WHEREAS, continuing to participate in this Agreement will allow the Department of
Fire -Rescue to continue providing such services on a contract basis; and
WHEREAS, said contract will bring revenue to the City in an annual amount of $545,328.00,
which is an $8,064.00 increase from the previous year's contract; and
WHEREAS, revenue funds are to be allocated to the following funding source:
0001.181000.438000.0000.00000; and
WHEREAS, the Village and the City desire to extend the provision of said services for a period
of five (5) years commencing October 1, 2016 on a contractual basis unless the Agreement is
can by either party in the manner provided in the Agreement;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized (1) to execute the Agreement, in substantially the
attached form, between the City and the Village, to provide fire rescue, automatic aid and ancillary
services to the Village, for a period of five (5) years commencing October 1, 2016 through September
30, 2021.
Section 3. This Resolution shall become effective immediately upon its adoption and signature
of the Mayor. {2)

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
