HomeMy WebLinkAboutR-18-0078City of Miami Legislation Resolution: R-18-0078 File Number: 3737 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 2/22/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER, IN CONJUNCTION WITH THE SUPERINTENDENT OF MIAMI-DADE COUNTY PUBLIC SCHOOLS, ALBERTO CARVALHO, THE SCHOOL BOARD OF MIAMI-DADE COUNTY ("SCHOOL BOARD"), AND THE MIAMI-DADE SCHOOLS POLICE DEPARTMENT, TO COLLABORATE EFFORTS AND AVAILABLE RESOURCES TO INCREASE THE SAFETY OF STUDENTS AND EMPLOYEES OF ALL PUBLIC SCHOOLS LOCATED IN THE CITY OF MIAMI AGAINST GUN VIOLENCE INCIDENTS; FURTHER DIRECTING THE CITY MANAGER TO RETURN TO THE CITY COMMISSION WITH RECOMMENDATIONS TO ENTER INTO NEW AGREEMENTS AND/OR PROPOSE AMENDMENTS TO EXISTING MUTUAL AID AGREEMENTS BETWEEN THE CITY OF MIAMI AND THE SCHOOL BOARD AND THE MIAMI- DADE PUBLIC SCHOOLS POLICE DEPARTMENT; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. SPONSOR(S): Vice Chair Ken Russell WHEREAS, tragedy struck our neighbors in Parkland, Florida last week when an armed 19 -year-old man gunned down students and staff of Marjory Stoneman Douglas High School killing 17 people and wounding many more; and WHEREAS, students attending school in the City of Miami ("City") should feel safe from gun violence incidents and no parent should ever fear for the well-being of their child while in the care of their school; and WHEREAS, it is the responsibility of the School Board of Miami -Dade County, Florida, ("School Board"), the Miami -Dade Schools Police Department ("MDSPD"), and City to ensure the public safety of students attending school by providing adequate levels of police services to address critical incidents as well as any routine situations; and WHEREAS, the School Board has made a state funding request of an additional 30 million dollars to provide for additional MDSPD officers, renovations to existing schools to limit access points into school campuses, to procure cyber security software to detect threats on social media, and other measures to advert gun violence in public schools; and WHEREAS, while the funding request is pending and during the implementation of these measures, it is in the best interest of the students and employees of public schools in the City to collaborate efforts and dedicate available resources in order to provide immediate safety measures; and WHEREAS, because of the existing and continuing possibility of the occurrence of law enforcement situations, and other natural and man-made conditions which are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the MDSPD or the City of Miami Page 1 of 2 File ID: 3737 (Revision:) Printed On: 5/22/2018 File ID: 3737 Enactment Number: R-18-0078 Miami Police Department, the City may, from time to time, enter into Mutual Aid Agreements pursuant to Chapter 23, Florida Statutes, entitled "Florida Mutual Aid Act"; and WHEREAS, based on recent events involving mass shootings in public schools, the City Commission finds that it is in the best interest of the City and its residents to conduct a review of any existing Mutual Aid Agreements with the School Board and MDSPD to recommend either amendments to same or recommend a new Mutual Aid Agreement between these agencies to provide for joint law enforcement responses and better interagency communications to share information and notify the appropriate agency of immediate threats of gun violence; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby directed, in conjunction with the Superintendent of Miami -Dade County Public Schools, Alberto Carvalho, the School Board, and the MDSPD, to collaborate efforts and available resources to increase the safety of students and employees of all public schools located in the City against gun violence incidents. Section 3. The City Manager is further directed to return to the City Commission with either recommended amendments to existing mutual aid agreements between the City and the School Board and/or MDSPD or recommend a new proposed mutual aid agreement to provide for safety measures against gun violence in public schools. Section 4. The City Clerk is hereby directed to transmit a copy of this Resolution to the Superintendent Alberto Carvalho, the members of the School Board, and to the Chief of MDSPD. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
