A. GENERAL INFORMATION:
REQUEST: Pursuant to Article 7, Section 7.1.2.8, of Ordinance 13114, as amended, the
applicant is requesting a Change of Zoning from Civic Institution (CI) to Urban Core Transect
Zone T6-80-0 for the property identified with the Folio No.: 0101070901050, and assigned with the
address commonly known as 144 NE 5 Street, Miami, Florida. (Complete legal description of the
property is on file with the Hearing Boards Office).
As a companion item for this request, the applicant is requesting a rezoning of the subject
parcel from Major Institutional, Public Facilities, Transportation, and Utilities to "Central
Business District" (File ID No.: 16-007191u), which is the Future Land Use Map (FLUM)
classification that corresponds to the proposed Transect Zone.

B. COMPREHENSIVE PLAN:
As it is stated above in "A. General Information", the rezoning requested requires a FLUM
amendment which is proposed in the companion item identified with the File ID No.: 16-
007191u. The staff report conducted for said item deemed FLUM amendment designation
from "Major Institutional, Public Facilities, Transportation, and Utilities" to "Central Business
District" appropriate and consistent with the Goals and Policies of the current Miami
Comprehensive Neighborhood Plan (MCNP).
C. BACKGROUND:
The subject property, owned by the City of Miami, is an interior regular lot of approximately
28,000 sq.ft or .642 acres' located in the north portion of the city block generally bounded
by NE 51" Street by the north, NE 2nd Avenue by the east, NE 41" Street by the south, and
NE 1St Avenue by the west.
The subject property is currently developed for the Fire Station No.1. Per Miami 21 Code,
fire stations are categorized as "Community Support Facility", which is defined as a facility
providing basic services, for the benefit and service of the population of the community in
which it is located.
This type of facility is allowed in the current Transect Zone (Civic Institution "Cl") as well as
in the proposed Urban Core Transect Zone T6-80-0. Under Cl regulations the current use is
allowed by Exception process, and under T6-80-0 it is allowed by Warrant process.

designation of the surrounding area.

The following is a review of the request pursuant to the rezoning criteria in Article 7, Section
7.1.2.8 (a)(1), (a)(3), (c)(1) & (f)(2) of Miami 21. The background section of this report is
hereby incorporated into the analysis and its corresponding criteria by reference:
Criteria 1 Sec.7.1.2.8 (c) (1) Except where the proposal for the rezoning of property
involves an extension of an existing Transect boundary, no rezoning of
land shall be considered which involves less than forty thousand (40,000)
square feet of land area or two hundred (200) feet of street Frontage on
one (1) street.
Analysis of The proposal of the rezoning involves the extension of an existing
Criteria 1 T6-80-0 located north to the subject property.
Finding 1 The request is consistent with the Miami 21 Code requirements for
rezoning.
Criteria 2 Sec.7.1.2.8 (a) (1): When a Cl zoned property ceases to be used for Civic

lowest Intensity Abutting Transect Zone, and rezoning to that Zone's next
higher Intensity Zone.
Analysis of The subject property is currently zoned with Cl Transect Zone and is
Criteria 2 developed for the Fire Station No.1.
The closeness to educational centers, park designated areas, and to the
metrovover station assign to the property a great potential to be
developed with a mix used project which can comprise a fire station.
Policy HO -1.19 of the Miami Comprehensive Neighborhood Plan
(MCNP) states that the City's land development regulations will
encourage high density residential development and redevelopment in
close proximity to Metrorail and Metromover stations.
Designating the subject parcel with the requested T6-80-0 zoning
classification will confer the property the lowest Intensity Abutting
Transect Zone.
By granting the rezoning, the property will be able to house a mix -used
project which may or may not include a fire station.
Assigning a residential component capacity to the subject parcel, the city
will be promoting compliance with the Policy HO -1.19 of the MCNP, by
following the procedure contemplated in Miami 21 Code Sec.7.1.2.8 (a)
(1).
Finding 2 Approval of the request would be consistent with the goals and objectives
of the MCNP and Miami 21 Code.
Criteria 3 Sec. 7.1.8 (a)(3) contains a table for successional zoning, which
establishes that the abutting zones to and existing Cl are considered its
natural successional zoning classification.
Analysis of Because T6-80-0 is the abutting zones to an existing Cl, it is considered
Criteria 3 the natural successional zoning classification for the subject property.
Finding 3 The request is consistent with the goals and objectives of the Miami 21
Code.

F. CONCLUSION:
Based on the materials submitted, staff finds that the request to rezone from Civic Institution
(CI) to Urban Core Transect Zone T6-80-0 for the property identified with the Folio No.:
0101070901050, and assigned with the address commonly known as 144 NE 5 Street,
Miami, Florida is consistent with the goals and objectives of Miami 21 Code.
G. RECOMMENDATION:
Pursuant to Article 7, Section 7.1.2.8 of Ordinance 13114, as amended and the
aforementioned findings, the Department of Planning and Zoning recommends approval of
the proposed rezoning from Civic Institution (CI) to T6-80-0 Urban Core Transect Zone as
presented.

COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE
NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "CI" CIVIC
INSTITUTION ZONE TO 76-80-0" URBAN CORE TRANSECT ZONE- OPEN, FOR THE
PROPERTY LOCATED AT APPROXIMATELY 144 NORTHEAST 5 STREET, MIAMI, FLORIDA;
MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.

PURPOSE: This will change the above property from "Cl" Civic Institution to 76-80-0" Urban
Core Transect Zone - Open. This item has a companion item for FLUM amendment.

WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on June 15,
2016, following an advertised public hearing, adopted Resolution No. PZAB-R-_ by a vote of
_ to _ (_ _), item No. _, recommending of the Zoning Change as set forth; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City of Miami and its inhabitants
to grant this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, is further
amended by changing the zoning classification from "Cl" Civic Institution to 76-80-0" Urban
Core Transect Zone - Open, for the property located at approximately 144 NE 5 Street, Miami,
Florida, as described in "Exhibit A", attached and incorporated.
Section 3. If any section, part of section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. It is the intention of the City Commission that the provisions of this
Ordinance shall become and be made a part of the Miami 21 Code of the City of Miami, Florida,
as amended, which provisions may be renumbered or relettered and that the word "ordinance"
may be changed to "section", "article", or other appropriate word to accomplish such intention.
Section 5. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof, pursuant and subject to §163.3187(5)(c), Florida Statutes.{1}
