HomeMy WebLinkAboutR-16-0370Vop City of Miami Legislation < U R �O Resolution: R-16-0370 File Number: 16-00925 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/29/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A COMMUNITY AESTHETIC FEATURE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION, COMPLETION, AND MAINTENANCE OF A DR. MARTIN LUTHER KING, JR. MURAL ON THE SOUTH SIDE OF THE I-95 OVERPASS AT NORTHWEST 62ND STREET AND FOR RENOVATIONS TO THE CENTER COLUMNS OF THE SAME. WHEREAS, the City of Miami ("City") has jurisdiction over and maintains the State Road 1-95 Overpass at the Northwest 62nd Street corridor ("Overpass") within the corporate limits of the City; and WHEREAS, the City desires to execute a Community Aesthetic Feature Agreement ("Agreement") with the State of Florida ("State") Department of Transportation ("FDOT"), in substantially the attached form, for the required State authorization to proceed with the beautification of the Overpass and its center columns; and WHEREAS, the Liberty City Community Revitalization Trust, an instrumentality of the City ("Liberty City Trust"), wishes to beautify the Overpass by installing a mural honoring Dr. Martin Luther King, Jr. and renovating the center columns of the Overpass ("Project"); and WHEREAS, under separate Resolution, and in support of the beautification efforts of the Liberty City Trust, the City and the Liberty City Trust will execute an Interlocal Agreement for the provision of funding for the Project and its maintenance totaling approximately $90,000.00; and WHEREAS, the Liberty City Trust has selected and approved an award of a Service Agreement to Moving Lives Kids Arts Center (MLK Arts Center), Inc. ("MLK Arts Center"), a Pennsylvania not for profit corporation registered to do business in Florida, for the Project; and WHEREAS, the MLK Arts Center has promised that the Project will not disrupt vehicular or pedestrian traffic through and around the Overpass and will maintain the Project for ten (10) years after its installation and completion; and WHEREAS, the MLK Arts Center has agreed to complete the Project subject to the terms and conditions detailed in the Community Aesthetic Feature Agreement ("Agreement"), attached and incororated; and WHEREAS, the City, the State, and their respective officers are authorized to enter into this Agreement pursuant to Sections 334.044(7) and 339.12, Florida Statutes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, City of Miand Page 1 of 2 File Id. 16-00925 (Version: 1) Printed On: 5/17/2018 File Number: 16-00925 FLORIDA: Enactment Number: R-16-0370 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the Agreement, in substantially the attached form, with FDOT for the installation, completion, and maintenance of the Project. Section 3. This Resolution shall become effective immediately upon its adoption and signature of Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
