HomeMy WebLinkAboutLegislationix � m `°y City Hall 3500 Pan American Drive *1, ,G."1'*1� ` Legislation Miami, FL 33133 gj4 j www.miamigov.com Resolution File Number; 16-00859 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE PROCUREMENT OF INFORMATION TECHNOLOGY TALENT MENTORSHIP AND APPRENTICESHIP PROGRAM SERVICES FROM THE LAUNCHCODE FOUNDATION, INC., A NOT FOR PROFIT CORPORATION REGISTERED TO DO BUSINESS IN FLORIDA, FOR THE CITY OF MIAMI'S INFORMATION TECHNOLOGY DEPARTMENT ("IT DEPARTMENT"), FOR ATWO (2) YEAR TERM WITH THE OPTION TO RENEW FOR THREE (3) ADDITIONAL ONE (1) YEAR PERIODS; ALLOCATING FUNDS FROM THE IT DEPARTMENT'S PROFESSIONAL SERVICES FUND SOURCE, WITH FUTURE YEARS' FUNDING SUBJECT TO AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the City of Miami's ("City") Information Technology Department ("IT Department") is in dire need of programmers, and has a need for a company with the capacity to recruit, screen, train, and place apprentices within the IT Department to fill some of the entry level positions; and WHEREAS, The LaunchCode Foundation, Inc. ("LaunchCode"), a not for profit job placement firm, has the capabilities to provide apprenticeships in technology for potential entry level jobseekers in the Information Technology field that do not possess formal Information Technology education; and WHEREAS, LaunchCode is the only provider identified through market research to provide Information Technology Talent Mentors hip/Apprenticeship Program Services ("IT Program Services"); and WHEREAS, LaunchCode has partnered with Miami Dade College to focus their services in the Greater Miami Community, and has received a sizeable investment by the John S. and James L. Knight Foundation of over $1,000,000.00 in support of LaunchCode's reach into all communities across Miami -Dade County; and WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended ("City Code"), the Chief Procurement Officer has adopted a finding that LaunchCode is the sole source provider of IT Program Services; and City of Mia in1 Page 1 of 2 File Id 16-00859 (Yersi.on: 1) Printed On.: 711912016 File Number: 16-00859 WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirements for competitive sealed bidding procedures be waived and that the procurement of IT Program Services, as specified, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code, after an advertised public hearing, the City Manager's finding of a sole source, is ratified, approved and confirmed, the requirements for competitive sealed bidding procedures are waived, and the City Manager is authorized to enter into an Agreement with LaunchCode, for IT Program Services, for the IT .Department on an as needed basis, for a two (2) year term with the option to renew for three (3) additional one (1) year periods, with funds allocated from IT Department's Professional Services Fund source, with future years' funding subject to the availability of funds and budgetary approval at the time of need. Section 3. The City Manager is {1} authorized to execute the Agreement, in substantially the attached form, and negotiate and execute all other documents and modifications to said Agreement, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: VI&ORIA ftNDEZ CITY ATTORNEY Footnotes: {1} This herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
