Purpose of Item:
A Discussion Item of the Miami City Commission regarding Request for Proposals No. 12-14-077, for
the lease and development of City of Miami owned waterfront property for marinas/restaurant/ship's
store uses located in Virginia Key, to either accept the City Manager's recommendation, reject the City
Manager's recommendation, reject any or all proposals, reject all proposals and instruct the City
Manager to issue a new Request For Proposals, or seek a recommendation from the Selection
Committee, with City Commission action following the discussion.

Subject: Discussion Item to review Request for Proposals No. 12-14-077, for lease of City -owned
waterfront property located in Virginia Key (also known as "Virginia Key Marina").
Background Information:
The City of Miami ("City") owns the property located in Virginia Key Marina, and more particularly
described in RFP 12-14-077 and all exhibits, attachments, and addenda thereto ("Property"). On June
15, 2015 the City issued Request for Proposals No. 12-14-077 ("RFP"), to solicit an integrated
package for planning, design, construction, leasing and management services from the private sector
to operate the Property for marinas/restaurant/ship's store uses. Three (3) proposals were received in
response to the RFP from New Rickenbacker Marina, LLC ("Tifon") Virginia Key SMI, LLC
("Suntex"); and Virginia Key, LLC ("RCI Group").
Pursuant to the RFP, the City Manager appointed the Selection Committee ("Committee") to evaluate
proposals received in response to the RFP. The Committee met on March 16, 2016 to evaluate the
criteria and the scoring values assigned and determine a rank order based on the score achieved and
render a written Memorandum for Recommendation for Final Selection to the City Manager.
The Committee recommended to the City Manager that the City negotiate with the highest ranked
proposer, RCI Group. The City Manager approved the recommendation of the Committee. Pursuant to
Section 18-104 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled
"Resolution of Protested Solicitations and Awards", both Tifon and Suntex submitted written notices
of intent to file a protest and written protests with the necessary filing fees.
The Director of DREAM, acting as Chief Procurement Officer, reviewed the protests submitted on
behalf of Tifon and Suntex, and determined that both of the protests should be denied. The City
Commission approved the DREAM Director's and City Manager's recommendation to reject the
protests on June 22, 2016. The City Commission also approved the Virginia Key Advisory Board's
recommendation to remove the wet slips from the Virginia Key historic basin on June 22, 2016.
The City Commission shall consider the Request for Proposals No. 12-14-077, and the proposals
received, and all determine whether it shall accept the City Manager's recommendation, reject the City
Manager's recommendation, reject any or all proposals, reject all proposals and instruct the City
Manager to issue a new Request For Proposals, or seek a recommendation from the Selection
Committee.
The above actions and procedures have been performed in accordance with applicable City Charter,
Code, and RFP provisions.
