HomeMy WebLinkAboutR-16-0324Vop City of Miami ' Legislation < U R �O Resolution: R-16-0324 File Number: 16-00956 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/14/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING ("MOU"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE CITY OF MIAMI BEACH, MIAMI-DADE COUNTY, AND THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR THE BEACH CORRIDOR DIRECT CONNECTION PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY OTHER DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO ACCOMPLISH THE INTENT OF THE MOU. WHEREAS, the cities of Miami and Miami Beach, the Florida Department of Transportation, and Miami -Dade County (collectively, "Parties"), wish to continue the efforts already underway to improve regional mobility which has involved local, regional, and state stakeholder collaboration and coordination; and WHEREAS, such efforts include the Parties' ongoing identification of optimum multimodal alternatives for a balanced regional transportation system, and the defining of regional and local projects that support transit -oriented development through effective transportation and land use planning; and WHEREAS, each of the Parties has unique skills and abilities which are necessary for the successful implementation of the Beach Corridor Direct Connection Project ("Project"), formerly known as BayLink, a fixed guideway corridor between downtown Miami near the Government Center to the Miami Beach Convention Center via the MacArthur Causeway; and WHEREAS, the Parties acknowledge the potential transportation, economic, social, and environmental benefits of the introduction of a passenger rail service linking downtown Miami with the Convention Center in Miami Beach; and WHEREAS, the Project will improve east -west mobility, promote redevelopment and revitalization, enhance and integrate existing Miami -Dade County transit services, and improve circulation in the two (2) downtown areas by introducing passenger service in the Project corridor as an efficient alternative to congested streets and highways; and WHEREAS, pursuant to Resolution No. 16-0056, adopted February 11, 2016, the City Commission approved the original Memorandum of Understanding ("Agreement") between the Parties; and WHEREAS, an amendment to the Agreement is necessary to reflect the shift of responsibilities from the Florida Department of Transportation to Miami -Dade County, as further described in Exhibit "A", attached and incorporated ("MOU"); and WHEREAS, Miami -Dade County will act as the lead agency regarding the National Environmental City of Miand Page 1 of 2 File Id. 16-00956 (Version: 1) Printed On: 5/14/2018 File Number: 16-00956 Enactment Number: R-16-0324 Policy Act document dealing with the Midtown to Alton Road and 5th Street Intermodal Stations; and WHEREAS, the City Administration recommends that the City Commission enter into the MOU, in substantially the attached form, and authorize the City Manager to execute any other documents, in a form acceptable to the City Attorney, in order to accomplish the intent of the MOU; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by referenced and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute the MOU, in substantially the attached form, between the Parties, for the Project. Section 3. The City Manager is authorized {1} to execute any other documents, in a form acceptable to the City Attorney, in order to accomplish the intent of the MOU. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
