HomeMy WebLinkAboutLegislationFile Number: 16-00819 City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.nilamigov.com Final Action Date; A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE CITY OF MIAMI ("CITY") EMPLOYEES' WORKFORCE HOUSING DOWN PAYMENT ASSISTANCE PROGRAM, AS DESCRIBED IN ATTACHMENT "A", ATTACHED AND INCORPORATED ("PROGRAM"); AUTHORIZING THE TRANSFER OF FUNDS, IN THE AMOUNT OF $1,000,000.00, FROM THE CITY'S AFFORDABLE HOUSING TRUST FUND; ALLOCATING SAID FUNDS TO THE CITY'S DEPARTMENT OF COMMUNITYAND ECONOMIC DEVELOPMENT FOR THE PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 06-0213, adopted on April 6, 2006, the City of Miami ("City") Employees' Workforce Housing Downpayment Assistance Program ("Program") was established and the City Commission authorized the transfer of funds, in the amount of $2,500,000.00, from the City Affordable Housing Trust Fund to the Program; and WHEREAS, the Program's goal is to incentivize and assist City employees that wish to reside in the community in which they work, thereby improving the quality of life for both the employee and neighboring residents; and WHEREAS, pursuant to Resolution No, 070225, adopted on April 12, 2007, the City Commission authorized the transfer of funds, in the amount of $2,000,000.00, from the Program to the City's Department of Community Development, Affordable Housing Trust Reserve Account, for the development of future affordable housing, thus, leaving an amount of $500,000,00 for the Program; and WHEREAS, due to the price of properties at that time and the maximum amount of $25,000.00 per employee, only twenty (20) employees were able to use the Program; and WHEREAS, the Program is still needed in today's market to incentivize employees to own properties in the City and provide additional means of contributing to the quality of life in the City; and WHEREAS, the City Administration recommends the transfer of funds, in the amount of $1,000,000.00, from the City's Affordable Housing Trust Fund, allocating said funds to the City's Department of Community and Economic Development, for the Program, as described in Attachment "A", attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted, by reference and incorporated as if fully set forth in this Section. The City's Program is amended, as described in Attachment "A", attached and incorporated. Section 3. The transfer of funds, in the amount of $1,000,000.00, from the City's Affordable Housing Trust Funds, to the City's Department of Community and Economic Development, for the Program, is authorized. {1} Section 4. The City Manager is further authorized {1} to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2) AS TO RM A lL CORRECTNESS: CCTORIA MENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the CityAttorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
