ReS®iut!®Ml File Number: 16-00793 City Hall 3500 Pan American Drive Miami, FL 33133 www.mlamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE EXPENDITURE OF FUNDS FROM THE CITY OF MIAMI POLICE DEPARTMENT LAW ENFORCEMENT TRUST FUND, IN AN AMOUNT NOT TO EXCEED $25,000,00, FOR THE PURPOSE OF FUNDING THE POLICE ATHLETIC LEAGUE PROGRAM, TO ASSIST WITH EXPENSES RELATED TO THE OPERATION OF ITS PROGRAMS; ALLOCATING FUNDS FROM THE CITY OF MIAMI POLICE DEPARTMENT LAW ENFORCEMENT TRUST FUND, AWARD NO. 1019, PROJECT NO. 19-690002, ACCOUNT CODE NO, 12500.191602.883000.0000; WITH SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH STATE STATUTES AND FEDERAL GUIDELINES, WHEREAS, Section 932.7055, Florida Statutes, the United States Department of Justice's ("DOJ") "Guide to Equitable Sharing of Federally Forfeited Property for State and Local Law Enforcement Agencies", and the United States Department of the Treasury's "Guide to Equitable Sharing for Foreign Countries and Federal, State, and Local Law Enforcement Agencies" (collectively, "Guides") provide guidelines for the expenditure of cash and proceeds received from state and federal forfeiture programs; and WHEREAS, Section 932,7055(5)(a), Florida Statutes, provides that monies received through the Florida Contraband Forfeiture Act and DOJ's Equitable Sharing Program shall be deposited in a special Law Enforcement Trust Fund ("LETF") and such proceeds and interest earned therefrom shall be used for school resource officers, crime prevention, safe neighborhoods, drug abuse education and prevention programs, or other law enforcement purposes; and WHEREAS, the Miami Police Department ("MPD"), through the Police Athletic League ("P.A.L."), is committed to the education and development of the youth in the City of Miami ("City") in a safe and productive environment; and WHEREAS, P.A.L.'s programs are designed to focus on the prevention of juvenile delinquency and steer youngsters clear of violent and other destructive behaviors through the use of educational and athletic activities; and WHEREAS, the Chief of Police has recommended adoption of this Resolution authorizing the expenditure of funds from MPD's LETF to P.A.L., in an amount not to exceed $25,000.00, to assist with expenses related to the operation of P.A.L.'s programs; and WHEREAS, the Chief of Police has determined that the proposed funding expenditure complies with the Guides and the requirements of Section 932.7055, Florida Statutes; and WHEREAS, funds for the program have not been included in the Police Department's normal operating budget, but are available in MPD's LETF; and WHEREAS, pursuant to the provisions of the Guides, P.A.L. shall: 1) certify that funds City of Dllanri page I of 2 File Id: 16-00793 Jlerslon:1) Printed On: 6128/2016 File Number., 16-00793 appropriated will be used lawfully and for the purpose stated; 2) maintain proper accounting records for the expenditure of such monies; and 3) provide any reports, including but not limited to audit reports, as may be required by the City or applicable law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The expenditure of funds, in an amount not to exceed $25,000.00, from the MPD LETF, for the purpose of funding P.A.L, to assist with expenses related to the operation of P,A.L.'s programs, with such expenditure having been approved by the Chief of Police pursuant to Section 932.7055, Florida Statutes and in compliance with the Guides, is authorized. Section 3. Funds are to be allocated from the Law Enforcement Trust Fund, Award No, 1019, Project No, 19-690002, Account Code No, 12500.191602.883000.0000. Section 4, This Resolution shall become effective immediately upon its adoption and signature of the Mayor. (1) AS TO SRM AND CORRECTNESS: V,TORiA iENDE, CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
