BVEHNA opposed to the Appeal of the HEP Board decision
2. Due Process and Rule of Law: The HEP Board is empowered by the City Charter to act in the
manner it has opted to. On what grounds will the commission reverse the decision of the
board?
a. CITY CHARTER Sec. 62-28. - Functions, powers and duties, generally.
In addition to such other powers, duties, and authority as may be set forth elsewhere in this Code
and in the zoning ordinance, the board is hereby authorized to:
0 Maintain and update files from the county historic survey within the city for the purpose
of identifying and preserving those properties and neighborhoods of special historic,
aesthetic, architectural, archeological, paleontological, cultural, social, or political value
or interest.
• Serve as a quasi-judicial instrument to designate historic sites, historic districts, and
archeological zones pursuant to chapter 23 of the City Code.
3. Consistent with characteristic of the neighborhood and corridor:
Prior to May 2016, over 90 properties were registered as contributing properties. As of
today, more than 180 properties are registered as contributing structures. NO
ADDITIONAL HARDSHIP OR BURDEN IS BEING IMPOSED ON THE
APPLICANT THAT HAS NOT BEEN IMPOSED ON MORE THAN 65% OF
SIMILAR PROPERTIES.
4. Current Use versus Future Use:
a. The property is currently two detach buildings consisting of 3 units. The building
has overwhelming characteristics similar to its block and context. Being registered
as a contributing structure does not affect the current use of the property.
b. The property is currently zoned T31, and will not be impacted the HEP board
decision.
