Should you have any questions, feel free to contact me at your convenience, APPROVI: ISAPPROVED: CC: Anna Medina, Agenda Office Rl,:al,--b a�P� nit l�wy City ®f Miami City Hall ' 3500 Pan American Drive RMG 1. k " " � Miami, FL 33133 Legislation www.miamigov.com y 'kms Resolution File Number: 16-00786 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND PSBP INDUSTRIAL, L.L.C,, FOR THE USE OF APPROXIMATELY TWO THOUSAND SIX HUNDRED FORTY (2,640) SQUARE FEET OF WAREHOUSE/OFFICE SPACE, FOR THE OPERATION OF THE INTERNALAFFAIRS DIVISION OF THE MIAMI POLICE DEPARTMENT ("MPD"), WITH A MONTHLY RENTAL FEE OF $2,213.20 ($10.06 PER SQUARE FOOT), ANNUAL INCREASES AS SET FORTH IN THE AGREEMENT, AND ESTIMATED MONTHLY OPERATING EXPENSES OF $646.80 ($2.94 PER SQUARE FOOT), FOR AN ESTIMATED TOTAL OF $2,860.00 PER MONTH FOR THE FIRST CONTRACT YEAR, COMMENCING ON MAY 15, 2016 AND EXPIRING ON SEPTEMBER 30,2022; ALLOCATING FUNDS FROM MPD'S BUDGET, WITH TERMS AND CONDITIONS AS MORE SPECIFICALLY SET FORTH IN SAID AGREEMENT, WHEREAS, the City of Miami ("City") Police Department's Internal Affairs Division ("Division") is currently in holdover status in its current warehouse/ office space consisting of one thousand three hundred twenty six (1,326) square feet and the landlord wishes to lease the same to another tenant; and WHEREAS, the City's Department of Real Estate and Asset Management, along with NAI Miami, reviewed the current inventory of office space(s) on the market, and were able to locate a suitable location that fits the needs of the Division at a monthly rental fee of $10.06 per square foot and estimated operating expenses of $2.94 per square foot; and WHEREAS, the City and PSBP Industrial, L,L.C. ("Lessor"), wish to enter into this Lease Agreement ("Agreement") commencing on May 15, 2016, upon execution of the Agreement, and expiring on September 30, 2022, subject to the rent increases provided for in the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized {1} to execute the Agreement, in substantially the attached form, between the City and Lessor, for the use of approximately two thousand six hundred forty (2,640) square feet of warehouse/ office space, for the operation of the Division, with a monthly rental fee of $2,213.20 ($10.06 per square foot), annual increases as set forth in the Agreement, and estimated monthly operating expenses of $646,80 ($2,94 per square foot), for an estimated total of $2,860.00 per month for the first contract year, commencing on May 15, 2016 and expiring on September 30, 2022. Funds to be allocated from MPD's budget, with terms and conditions as more specifically set forth in said Agreement, Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} AS TO FOeM AND QORRECTNESS; Z EY Footnotes: (1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2) If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
