HomeMy WebLinkAboutExhibitCERTIFICATION AND DECLARATION OF RESULTS FOR THE GENERAL MUNICIPAL AND SPECIAL ELECTIONS HELD ON NOVEMBER 7, 2017 STATE OF FLORIDA ) MIAMI-DADE COUNTY ) CITY OF MIAMI ) I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps were taken in connection with the conduct of the City of Miami's General Municipal and Special Elections held on November 7, 2017, including, though not limited to, the following: I. On Thursday, October 24, 2017: A. Commencing at approximately 10:00 a.m. the Miami -Dade County Supervisor of Elections conducted a logic and accuracy test of the touch screen and optical scan voting systems to be used for vote -by -mail, early voting and precinct ballots for the candidates and/or issues to be voted upon at the November 7, 2017 General Municipal and Special Elections. B. A member from the City of Miami's Canvassing Board compared the test results with the predetermined totals for each candidate and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment. II. On Thursday, November 2, 2017 through Tuesday, November 7, 2017: On Thursday, November 2, 2017, the Miami -Dade County Supervisor of Elections conducted the pre -count logic and accuracy test of the optical scan system used for vote -by -mail and provisional ballots. Additionally, at approximately 10:00 a.m., a majority of the City of Miami's Canvassing Board was in attendance to approve the commencement of vote -by -mail ballot opening, processing and duplication. The task of vote -by -mail ballot opening, processing and duplication was continued on an as needed basis until Tuesday, November 7, 2017. III. On Tuesday, November 7, 2017 through Friday, November 10, 2017: On Tuesday, November 7, 2017, at 6:00 p.m., the City of Miami's Canvassing Board met to canvass presumed invalid vote -by -mail ballots. After the completion of this task, the tabulation of election results was finalized and the Miami -Dade County Supervisor of Elections presented me with the UNOFFICIAL election results for the November 7, 2017 General Municipal and Special Elections. Per Section 101.048(1), Florida Statutes, persons casting provisional ballots have the right to Page 1 of 7 present written evidence supporting his or her eligibility to vote to the Supervisor of Elections by no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 9, 2017. On Friday, November 10, 2017 at 10:00 a.m., provisional ballots were canvassed by the City of Miami's canvassing Board. IV. Additionally, on Friday, November 10, 2017, after the canvassing of provisional ballots, the differential of votes cast for two of the seven candidates running for District 3 Commissioner (Alfonso "Alfie" Leon and Zoraida A. Barreiro) was 0.28 percent. Pursuant to Florida Statute 102.141(7), a mandatory machine recount was ordered and conducted by the City of Miami's Canvassing Board and Miami -Dade County Elections Department. After the machine recount, the differential between the two candidates was 0.23 percent. Pursuant to Florida Statutes 102.166, a manual recount was ordered and conducted by the City of Miami's Canvassing Board and Miami -Dade County Elections Department. After the manual recount of Over Votes and Under Votes for the District 3 Commissioner race, I received the OFFICIAL election results for the General and Special Elections in addition to an addendum to the OFFICIAL election results for the District 3 Commissioner race indicating that Joe Carollo and Alfonso "Alfie" Leon would be the two candidates participating in a run-off election for the District 3 seat. V. I further certify that on Tuesday, October 24, 2017, two (2) sets of documents containing all of the results of the Logic and Accuracy Tests validated that the tabulating equipment was functioning correctly and that said documents were signed off by the Miami -Dade County Supervisor of Elections and City Clerk. These documents were then placed in a sealed canvass bag under seal number 0051437. On Friday, November 10, 2017, the sealed canvass bag was opened and one (1) set of documents was retained by the Supervisor of Elections and the other set retained by the City Clerk. VI. This amendment ensures that the OIAG will continue to be free from interference or undue influence by City administration in the selection, appointment, and employment of OIAG staff. The amendment allows the OIAG to continue to form independent and objective opinions and conclusions in their audit and investigative work. I further certify and declare that: • for Mayor, Francis X. Suarez received more than 50 percent plus one of all votes cast and is hereby declared to have been elected as Mayor of the City of Miami; • for District 3 Commissioner, no candidate received a majority of votes cast and therefore a Run -Off Election will be required to determine who will be elected to the District 3 seat. Per City of Miami Charter Section 4(b), Joe Carollo and Alfonso "Alfie" Leon, having received the greatest number of votes cast in the General Municipal Election, shall be placed on the ballot for a Run -Off Election scheduled for November 21, 2017; • for District 4 Commissioner, Manolo Reyes received more than 50 percent plus one of all votes cast and is hereby declared to have been elected as Miami City Commissioner for District 4; • for District 5 Commissioner, Keon Hardemon ran unopposed. Pursuant to Section 101.151(7), Florida Statutes, "...the names of unopposed candidates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself or herself." Additionally, per Miami City Code Section 16-8, "[I]f, at the close of the qualifying period there is only one candidate's name listed on the general municipal election ballot for mayor or for a city commissioner for a specific district seat(s), no election for mayor or for a city commissioner for a specific district seat(s) shall be required, and said candidate or candidates shall be declared elected for that particular term(s) of office as of five days after the date of the scheduled general municipal election." In accordance Page 6 of 7 with Florida State Statutes and the Miami City Code, Keon Hardemon is hereby declared to have been elected as Miami City Commissioner for District 5; • for Coconut Grove Village Council Members, Johannah Brown, Rachel Cardello, Steven Dloogoff, Zachary Elliott, Marcelo Fernandes, Susanne Larissa Ozols, Henry "Hank" Sanchez -Resnik, Thaddeus G. Scott and Linda Williams were the nine (9) candidates that received the greatest number of votes cast and are hereby declared to have been elected Coconut Grove Village Council Members; • I further certify and declare that the Bond Referendum Question Authorizing General Obligation Bonds for Capital Projects in an aggregate principal amount not exceeding $400,000,000.00 was approved by the electorate and; • I further certify and declare that the following charter amendments were approved by the electorate: * Proposed Charter Amendment allowing Aligned Bayshore (Monty's) a Lease extension providing additional rent and investments * Charter Amendment to Include the Office of Independent Auditor General ("OIAG") as an Unclassified Service * Charter Amendment providing Independent Auditor General ("IAG") exclusive supervisory authority over Office of IAG employees * Charter Amendment to Fill Vacancy in Elected Office for the Remainder of an Unexpired Term VIII. On Monday, November 13, 2017 (Cancelled): A post-election manual audit by the Miami -Dade County Supervisor of Elections was scheduled at 2:00 p.m. at the Elections Department located at 2700 NW 87th Ave. Due to the fact that a manual recount was conducted for the District 3 race, the post-election audit was no longer necessary and therefore the Canvassing Board meeting was cancelled.
