Resolution File Number: 16-00591 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CITY OF MIAMI'S ("CITY") NEIGHBORHOOD STABILIZATION PROGRAM 3 ("NSP3") SUBSTANTIAL AMENDMENT #2016.1, AS INDICATED IN EXHIBIT "A", ATTACHED AND INCORPORATED, REFLECTING AN ALLOCATION OF $1,987,894.00 IN PROGRAM INCOME TO THE PROGRAM AND THE AMENDMENT OF THE AREAS OF GREATEST NEED, TO INCLUDE THE AREAS OF THE CITY'S INFILL PROGRAM, AND TO REMOVE AREAS WHICH CURRENTLY DO NOT QUALIFY; AUTHORIZING THE CITY MANAGER TO SUBMIT THE CITY'S NSP3 SUBSTANTIAL AMENDMENT #2016.1 TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR REVIEW AND APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, on July 21, 2010, the President of the United States signed the Dodd -Frank Wall Street Reform and Consumer Protection Act of 2010, which included the City of Miami's ("City") Neighborhood Stabilization Program 3 ("NSP3"), administered by the United States Department of Housing and Urban Development ("HUD"); and WHEREAS, the NSP3 provides funds to stabilize neighborhoods whose viability have been, and continues to be, damaged by the economic effects of properties that have been foreclosed and abandoned; and WHEREAS, pursuant to Resolution No. 15-0404, adopted on September 24, 2015, the City Commission approved the allocation of NSP3 program income in the amount of $2,208,771.00, which included an amount of $1,987,894.00, for eligible housing activities; and WHEREAS, to be able to spend the program income for eligible housing activities, there is the need to amend the NSP3 areas of greatest need to include current NSP3 projects and to remove areas that currently do not qualify for the program; and WHEREAS, the City Administration recommends the approval of the City's NSP3 Substantial Amendment #2016.1, as indicated in Exhibit "A", attached and incorporated, to reflect an allocation of $1,987,894.00 in program income to the program and the amendment of the areas of greatest need, to include the areas of the City's infill program, and to remove areas which currently do not qualify; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City's NSP3 Substantial Amendment #2016.1, as indicated in Exhibit "A", City of Munni Page I of 2 File Id: 16-00591 (Version: 1) Printed 0t::5/2012016 File Number: 16-00591 attached and incorporated, reflecting an allocation of $1,987,894.00 in program income to the program and the amendment of the areas of greatest need to include the areas of the City's infill program, and to remove areas which currently do not qualify, is approved.. Section 3. The City Manager is authorized {1} to submit the City's NSP3 Substantial Amendment #2016.1 to the HUD for review and approval. Section 4. The City Manager is further authorized {1} to execute any necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2}. ROVED AS TO FORM AND CORRECTNESS: VICTORIA RENDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
