HomeMy WebLinkAboutR-16-0257Vop City of Miami '"* Legislation < U R �O Resolution: R-16-0257 File Number: 16-00706 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/26/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY ADMINISTRATION TO PLACE FLORIDA HISTORICAL MARKERS COMMEMORATING PERSONS, PLACES, AND EVENTS IMPORTANT IN THE HISTORY OF THE CITY OF MIAMI, SPONSORED BY INTERESTED ENTITIES AND ORGANIZATIONS, INCLUDING BUT NOT LIMITED TO THE COCONUT GROVE CIVIC CLUB, SUBJECT TO THE CONFINES OF CHAPTERS 54 AND 55 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AND SUBJECT TO THE REQUIREMENT THAT THERE SHALL BE NO COMMERCIAL MESSAGE WHATSOEVER, THAT THE ENTIRE CONTENT OF THE FLORIDA HISTORICAL MARKERS SHALL BE LIMITED TO THE RECOGNITION OF PERSONS, PLACES AND EVENTS, AND THAT THE LOCATION AND CONTENT ARE SUBJECT TO APPROVAL AS A STANDARD CERTIFICATE OF APPROPRIATENESS; AUTHORIZING AND DIRECTING THE CITY MANAGER TO ASSIST WITH THE PLACEMENT OF SAID MARKERS THROUGHOUT THE CITY AND TO LIAISE WITH THE DEPARTMENT OF STATE DIVISION OF HISTORICAL RESOURCES FOR THE PERPETUAL MAINTENANCE OF THESE MARKERS SUBJECT TO THE CITY CODE AND THE MIAMI 21 CODE, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, INA FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH OTHER GOVERNMENTAL ENTITIES WHERE LOCATION SITES FALL WITHIN THEIR JURISDICTION FOR SAID PURPOSE. WHEREAS, the City of Miami Strategic Plan for fiscal years 2015 - 2017 priority areas for Culture and Recreation as well as for Clean and Beautiful Neighborhoods include the creation of beautiful and vibrant neighborhoods, the strengthening of the City of Miami's ("City") reputation as a global destination for culture, and the provision of opportunities for visitors to engage in leisure, recreation, and cultural exchange; and WHEREAS, there are non -City entities, agencies, organizations, and individuals, including the Coconut Grove Civic Club, who are desirous of commemorating persons, places, and events important in the history of the City; and WHEREAS, the Department of State, Division of Historical Resources provides maintenance in perpetuity for Florida Historical Markers once they have been installed; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The placement of Florida Historical Markers commemorating persons, places, and events important in the history of the City sponsored by interested entities and organizations, including but not limited to the Coconut Grove Civic Club, is directed, subject to the confines of Chapters 54 and 55 of the Code of the City of Miami, Florida, as amended ("City Code"), and subject to the requirement that there shall be no commercial message whatsoever, and that the entire content of the Florida Historical Markers shall be limited to the recognition of persons, places, and events and the location and content are subject to approval as a standard Certificate of Appropriateness. Section 3. The City Manager is authorized {1} and directed to assist interested entities, agencies, organizations, and individuals with the placement of Florida Historical Markers at eligible sites throughout the City, and to liaise with the Department of State Division of Historical Resources for the perpetual maintenance of these markers, subject to the City Code and the Miami 21 Code, the Zoning Ordinance of the City of Miami, Florida, as amended. Section 4. The City Manager is further authorized {1} to execute the necessary installation permits and or applicable interlocal documents, in a form acceptable to the City Attorney, with other governmental entities where the site locations fall within their jurisdiction for said purpose. Section 5. This resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
