HomeMy WebLinkAboutR-16-0256Vop City of Miami '"* Legislation < U R �O Resolution: R-16-0256 File Number: 16-00710 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/26/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE PROHIBITIONS IN SECTION 2-11.1 OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA, AS AMENDED, AND CONFORMING WITH SECTION 2-613 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, APPROVING ACCEPTANCE OF THE PAYMENT OF CERTAIN TRAVEL EXPENSES BY THE CITY OF MADRID, SPAIN, FOR A CONFERENCE ON PUBLIC-PRIVATE PARTNERSHIPS WHERE PARTICIPATION IS FOR THE USE AND BENEFIT OF THE CITY OF MIAMI ("CITY"); AUTHORIZING CITY MANAGER DANIEL J. ALFONSO AND PLANNING & ZONING DIRECTOR FRANCISCO J. GARCIATO REPRESENT THE CITY IN THIS CONFERENCE; DIRECTING THE CITY CLERK TO TRANSMIT COPY OF THIS RESOLUTION TO THE MIAMI-DADE COMMISSION ON ETHICS AND PUBLIC TRUST. WHEREAS, the City of Madrid's Office for the Promotion of International and Business Participation, an office committed to promoting the City of Madrid, Spain ("Madrid") internationally and developing external collaborative relationships, is hosting this Conference ("Conference") for the purpose of discussing Public -Private Partnerships; and WHEREAS, the City Manager and the Planning & Zoning Director will participate and present at the Conference on behalf of the City of Miami ("City"); and WHEREAS, the City and the City of Madrid entered into a Sister -City Agreement in 2014 and participation at this Conference will lead to increased ties between the City and Madrid; and WHEREAS, the Conference is found to serve a clear public purpose that benefits the City; and WHEREAS, City of Madrid's Office for the Promotion of International and Business Participation has offered to provide payment of certain travel expenses for the participation of City Manager Daniel J. Alfonso and Planning & Zoning Director Francisco J. Garcia at its Conference in Madrid; and WHEREAS, references to Miami -Dade County personnel in Section 2-11.1 of the Code of Miami -Dade County, Florida, as amended ("County Code"), are applicable to City personnel who serve in comparable capacities; and WHEREAS, Section 2-11.1(w) of the County Code prohibits the acceptance of travel expenses from anyone who is a contractor of the City unless a majority of the Miami City Commission waives the prohibition; and WHEREAS, Section 2-613 of the Code of the City of Miami, Florida, as amended ("City Code"), prohibits every officer, official or employee of the city from accepting, directly or indirectly, from any person, company, firm or corporation to which any purchase order or contract is or might be awarded, any rebate, gift, money or anything of value whatsoever, except where given for the use and benefit City of Miand Page 1 of 2 File Id. 16-00710 (Version: 1) Printed On: 5/8/2018 File Number: 16-00710 of the city; and Enactment Number: R-16-0256 WHEREAS, the City Commission believes it is in the best interest of the City for City Manager Daniel J. Alfonso and Planning & Zoning Director Francisco J. Garcia to represent the City at this Conference; and WHEREAS, the City Commission wishes to waive the prohibition and accept payment of certain travel expenses by the City of Madrid's Office for the Promotion of International and Business Participation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby waives the prohibitions in Section 2-11.1 of the County Code and conforms with Section 2-613 of the City Code, and approves acceptance of the payment of travel expenses by the City of Madrid's Office for the Promotion of International and Business Participation for its Conference in Madrid, which the City's participation in the Conference is for the use and benefit of the City. Section 3. City Manager Daniel J. Alfonso and Planning & Zoning Director Francisco J. Garcia are authorized {1} to represent the City at this Conference. Section 4. The City Clerk is directed to transmit a copy of this resolution to the Miami -Dade Commission on Ethics and Public Trust. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
