HomeMy WebLinkAboutLegislationf kl City of Miami Ie,te RAdkt° Legislation Resolution File Number: 16-00690 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE PERMANENT RESTRICTION OF VEHICULAR ACCESS, SUBJECT TO A MINIMUM NINETY (90) DAY TRIAL PERIOD, TO SOUTHWEST 34TH AVENUE AT ITS INTERSECTIONS WITH SOUTHWEST 11TH STREETAND SOUTHWEST 16TH STREET, MIAMI, FLORIDAAND SOUTHWEST 36TH AVENUE AT ITS INTERSECTION WITH SOUTHWEST 16TH STREET, MIAMI, FLORIDA; SUBJECT TO FINAL APPROVAL OF THE MIAMI-DADE COUNTY TRAFFIC DIRECTOR; SUBJECT TO CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE AGENCIES DESIGNATED HEREIN. WHEREAS, property owners in the La Pastorita neighborhood bounded by Southwest 32nd Avenue, Southwest 37th Avenue, Southwest 8th Street and Southwest 16th Street, Miami, Florida, have expressed concern about the unsafe conditions due to excess cut -through traffic and vehicular speeds within their neighborhood; and WHEREAS, Section 54-16 of the Code of the City of Miami, Florida, as amended, provides a procedure for the prohibition of vehicular access to a public street; and WHEREAS, the City of Miami ("City") Administration recommends the permanent restriction of vehicular access, subject to a minimum ninety (90) day trial period, to Southwest 34th Avenue at its intersections with Southwest 11th Street and Southwest 16th Street, Miami, Florida and Southwest 36th Avenue at its intersection with Southwest 16th Street, Miami, Florida; and WHEREAS, the Miami -Dade County Transportation and Public Works Department and the City's Police, Fire -Rescue, and Solid Waste Departments have reviewed the proposed prohibition of vehicular access and have no objections to the proposed restrictions being temporarily installed for a minimum ninety (90) day trial period; and WHEREAS, the City Commission finds that the herein restrictions of vehicular access, subject to a minimum ninety (90) day trial period, are in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. It is hereby directed that vehicular access be permanently restricted, subject to a minimum ninety (90) day trial period, to Southwest 34th Avenue at its intersections with Southwest 11th Street and Southwest 16th Street, Miami, Florida and Southwest 36th Avenue at its intersection with Southwest 16th Street, Miami, Florida, subject to final approval of the Miami -Dade County Traffic Director and subject to the following conditions: City of Miami Page I of 2 File Id 16-00690 (Version: 1) Printed On: 5/11/2016 File Number; 16-00690 a) Vehicular access shall be restricted by a barricade installed across the entire width of Southwest 34th Avenue and Southwest 36th Avenue at said intersections; b) The City's Public Works Department and Capital Improvements and Transportation Program shall design and accomplish the installation of the barricades; c) The design of the barricades shall be subject to review and modification by the Miami -Dade County Department of Transportation and Public Works; d) At a mutually agreed upon conclusion date of the trial period by the City and Miami -Dade County, the City's Public Works Department and Capital Improvements and Transportation Program shall evaluate the effectiveness of the temporary barricades and present the findings to the Director of the Miami -Dade County Department of Transportation and Public Works for a final determination as to their permanent placement; and e) All of the traffic regulatory signs shall be subject to review and modification by the Miami -Dade County Department of Transportation and Public Works. Section 3. Said barricades shall prevent vehicular access but not restrict pedestrian access. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the Miami -Dade County Transportation and Public Works Department and to the City's Police, Fire -Rescue, and Solid Waste Departments. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPRqVED VICTORIA M C ITY ATTO R Footnotes: CTNESS: {1} If the Mayor does not sign this Resolution, it shall becomeeffectiveat the end of ten (10) calendar days from the date it was passed and adopted. If the mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
