A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY
FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC
HEARING, RATIFYING, CONFIRMING AND APPROVING THE CITY MANAGER'S
WRITTEN FINDING OF AN EMERGENCY, PURSUANT TO SECTION 18-90 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"),
AND WAIVING COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO
SECTION 18-85 OF THE CITY CODE, AS AMENDED, FOR THE PROCUREMENT
OF THE MANUELARTIME THEATER HEATING, VENTILATION AND AIR
CONDITIONING SYSTEM COMPRESSOR, FAN MOTOR, AND MINOR
REPLACEMENT PARTS ASSOCIATED WITH REPAIRS FOR THE SAME, IN THE
AMOUNT OF TWENTY-EIGHT THOUSAND ONE HUNDRED FORTY-TWO
DOLLARS ($28,142.00) TO DEBONAIR MECHANICAL, INC. AS AN EMERGENCY
PROCUREMENT.
WHEREAS, the City of Miami's Department of Real Estate and Asset Management ("Department")
manages at the Manuel Artime Theater ("Theater"), the events held there on an ongoing basis, and
the many patrons that attend the same; and
WHEREAS, the Manuel Artime Theater experienced a heating, ventilation and air conditioning
("HVAC") system compressor failure in October 2015; and
WHEREAS, to allow continued usage of the Theater and avoid the safety issue ever-increasing
Theater temperatures pose to patrons, most of which are children and elderly, due to an inoperable
HVAC unit, the Department is seeking to expedite the repairs of the HVAC unit for the Theater; and
WHEREAS, a rental HVAC unit has been installed in the interim; and
WHEREAS, the City Manager, pursuant to Sections 18-85 and 18-90 of the Code of the City of
Miami, Florida, ("City Code") as amended, made an emergency finding on January 7, 2016 and
approved an emergency bid waiver selecting DebonAir Mechanical, Inc., for the procurement of the
Manuel Artime Theater HVAC system compressor, fan motor and minor replacement parts associated
with repairs for the same, in the amount of twenty-eight thousand one hundred forty-two dollars
($28,142.00), as an emergency procurement; and
WHEREAS, the City Manager approved this emergency procurement, in order to repair the HVAC
system in a timely manner, so as to alleviate -the -disruption -of service to patrons;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.

Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's findings of an emergency are ratified, confirmed and approved, and the requirements for
competitive sealed bidding procedures are waived pursuant to Sections 18-85 and 18-90 of the City
Code, as amended, for the procurement of the Manuel Artime Theater HVAC system compressor, fan
motor and minor replacement parts associated with the repairs for the same, in the amount of
twenty-eight thousand one hundred forty-two dollars ($28,142.00), to DebonAir Mechanical, Inc., as an
emergency procurement.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2)

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
(2) if the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
