A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO GRANT ALLAPATTAH BUSINESS
DEVELOPMENT AUTHORITY, INC. ("ABDA") AN EXTENSION OF TIME TO
COMPLETE CONSTRUCTION BY OCTOBER 25, 2017, ON THE PROPERTIES
LOCATED AT 790-92 NORTHWEST 29 TERRACE, 3255-57 NORTHWEST 11
COURT, AND 3245-47 NORTHWEST 11 COURT, MIAMI, FLORIDA, LEGALLY
DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 03-215, adopted February 27, 2003 and Resolution No.
04-0289, adopted on May 6, 2004, the City Commission designated certain City of Miami ("City")
owned properties as surplus and authorized Allapattah Business Development Authority, Inc.
("ABDA") to develop homes affordable to very low, low and/or moderate -income families and/or
individuals; and
WHEREAS, to date, ABDA has completed construction on three (3) of the six (6) lots conveyed;
and
WHEREAS, construction on 790-92 Northwest 29 Terrace, Miami, Florida, one (1) of the
remaining three (3) lots, has been completed but is pending water and sewer connection while the
remaining two (2) projects, located at 3255-57 and 3245-47 Northwest 11 Court, Miami, Florida
(collectively "Remaining Properties") are experiencing significant delays in permitting; and
WHEREAS, through various extensions and pursuant to Resolution No. 14-0124, adopted March
27, 2014 by the City Commission, ABDA had until September 27, 2014 to commence construction
and until September 27, 2015 to complete construction for the Remaining Properties; and
WHEREAS, due to issues stated above, ABDA could not complete construction within the
specified timeframe; and
WHEREAS, ABDA has been maintaining the Remaining Properties since the transfer and is
currently at the end of the permitting process; and
WHEREAS, the affordable housing to be provided in the community is still needed; and
WHEREAS, the Administration recommends granting ABDA an extension of time to complete
construction by October 25, 2017;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1 } to grant ABDA an extension of time to complete
construction by October 25, 2017, on the Remaining Properties, legally described in Exhibit "A",
attached and incorporated.
Section 3. It is the intention of the City Commission that title to the parcels described above and
in Exhibit "A", attached and incorporated, shall be deemed to have remained in ABDA from the date
of conveyance.
Section 4. The City Manager is authorized {1} to execute any required modifications to the
deed(s) that conveyed the Remaining Properties from the City of Miami to ABDA, and all other
necessary documents, in a form acceptable to the City Attorney, for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
