HomeMy WebLinkAboutR-16-0138Vop City of Miami Legislation < U R �O Resolution: R-16-0138 File Number: 16-00254 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 3/24/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING, PURSUANT TO SECTION 18-85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI FOR THE PROVISION OF COMMERCIAL CARD SERVICES WITH JPMORGAN CHASE BANK, N.A., ("JPMORGAN") FOR A TWELVE (12) MONTH PERIOD FROM APRIL 1, 2016 THROUGH MARCH 31, 2017, ALLOWING FOR CONTINUITY OF SERVICES AND PROCUREMENT OF A NEW CONTRACT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND AMENDMENT TO THE PARTICIPATION AGREEMENT WITH JPMORGAN, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. WHEREAS, the City Manager has determined that it is not practicable and advantageous to the City of Miami ("City") to adhere to competitive sealed bidding methods for the provision of Commercial Card ("P -Card") services, currently performed by JPMorgan Chase Bank, N.A. ("JPMorgan"), and, therefore, seeks a waiver of such requirements; and WHEREAS, on March 12, 2015, the City Commission adopted Resolution No. 15-00188, authorizing the City Manager to execute the First Amendment to the Participation Agreement with JPMorgan for a period of twelve (12) months from April 1, 2015 through March 31, 2016; and WHEREAS, the City Manager requests authorization to execute the Second Amendment to the Participation Agreement with JPMorgan, in substantially the attached form, for the extension of P -Card services for a period of twelve (12) months from April 1, 2016 through March 31, 2017; and WHEREAS, pursuant to Section 18-85, of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager recommends waiver of competitive sealed bidding methods via a written finding, with reasons supporting his conclusion attached herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, pursuant to Section 18-85 of the City Code, is ratified, approved and confirmed, and the requirement for competitive sealed bidding procedures as not being practicable or advantageous to the City for the provision of P -Card services with JPMorgan for a twelve (12) month City of Miand Page 1 of 2 File Id. 16-00254 (Version: 1) Printed On: 4/30/2018 File Number: 16-00254 Enactment Number: R-16-0138 period from April 1, 2016 through March 31, 2017, allowing for continuity of services and procurement of a new contract, is waived Section 3. The City Manager is authorized {1} to execute the Second Amendment to the Participation Agreement with JPMorgan, in substantially the attached form, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including, but not limited to, those prescribed by applicable City Charter and Code. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of the ten (10) Calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
