A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY OF
MIAMI TO PARTICIPATE AS A SIGNATORY ON THE AMICUS CURIAE BRIEF
BEING DRAFTED BY NATIONAL COALITION OF LOCAL GOVERNMENTS IN
DEFENSE OF THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY'S
CLEAN POWER PLAN.
WHEREAS, the New York Attorney General's Office is currently engaged with other state and
local governments in the defense of the United States Environmental Protection Agency's ("EPA")
Clean Power Plan in federal court; and
WHEREAS, the Clean Power Plan is intended to reduce carbon pollution from power plants; and
WHEREAS, the Clean Power Plan cuts carbon pollution and pollutants emitting from power plants
that cause soot and smog that harm health; and
WHEREAS, in 2009, the EPA determined that greenhouse gas pollution threatens the health and
welfare of Americans by leading to long-lasting changes in our climate; and
WHEREAS, carbon dioxide is the most prevalent greenhouse gas pollutant and the Clean Power
Plan reduces carbon dioxide emissions and drives investment in clean energy technologies; and
WHEREAS, the following delegation of states have supported the defense of the Clean Power
Plan: New York, California, Connecticut, Delaware, Hawaii, Iowa, Illinois, Massachusetts, Maryland,
Maine, New Hampshire, New Mexico, Oregon, Pennsylvania, Rhode Island, Virginia, Vermont,
Washington, and District of Columbia, as well as cities like New York City, New York; Boulder,
Colorado; Miami Beach, Florida; and Houston, Texas; and
WHEREAS, locally, Broward County, the City of Coral Gables, the City of Miami Beach, and the
City of South Miami have declared their support for the Clean Power Plan; and
WHEREAS, Mayor Tomas Regalado declared his support of the Clean Power Plan by signing a
joint letter along with elected officials from Broward County, the City of Coral Gables, and the City of
South Miami; and
WHEREAS, the City Commission ("Commission") passed Resolution 15-0548 on December 10,
2015 declaring its support of the Clean Power Plan and the New York Attorney General's efforts to
defend the Clean Power Plan; and
WHEREAS, the Supreme Court of the United States recently issued a stay of the enforcement of
the Clean Power Plan pending the conclusion of the litigation in federal court; and
WHEREAS, a national coalition of local governments, including the cities of Miami Beach and

Coral Gables, are planning to jointly file an amicus curiae brief defending the Clean Power Plan in
federal court; and
WHEREAS, the Commission wishes to lend its support to these efforts; and
WHEREAS, the Commission authorizes the City of Miami to participate as a signatory on the
amicus curiae brief in defense of the EPA's Clean Power Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission authorizes the City of Miami to participate as a signatory on the
amicus curiae brief being drafted by a national coalition of local governments in defense of the EPA's
Clean Power Plan.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1 }

{1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten
(10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
