Chief ;;_Z 3 ba Icc City P Page 1 of 1 Vol BACKGROUND INFORMATION The Brickell City Centre LLC (Grantor) is the fee simple owner and has a leasehold interest in certain real property located on the south side of SE 6 Street between South Miami Avenue and SE 1 Avenue. The Grantor is constructing a mixed use commercial/retail/residential development on their property as part of the larger Brickell City Centre. The City has granted to the Grantor the right to construct non-standard improvements, including but not limited to hardscaping, landscaping and lighting, within the City's right-of-way known as SE 6 Street between South Miami Avenue and SE 1 Avenue. The Grantor's improvements contemplate the relocation of a public sidewalk from the City's right-of-way onto the Grantor's private property in certain locations. The Grantor has agreed to grant a non-exclusive Perpetual Sidewalk Easement to the City for the purpose of public pedestrian access to those portions of the sidewalk constructed on the Grantor's property abutting the City's right-of-way. Miami -Dade County, the owner of a portion of the property leased to the Grantor, has agreed to give its consent to the granting of the easement.
