AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES/NONSTANDARD STREET WIDTHS", BY MODIFYING THE
WIDTH OF NORTHEAST/NORTHWEST 9TH STREET BETWEEN NORTHEAST
1ST AVENUE TO NORTHEAST 2ND AVENUE, NORTH MIAMI AVENUE TO
NORTHWEST 1ST AVENUE (EAST) AND NORTHWEST 2ND AVENUE TO
INTERSTATE 95, MIAMI, FLORIDA; CONTAINING A SEVERABILITY CLAUSE AND
PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, Article V of Chapter 54 of the Code of the City of Miami, Florida, as amended ("City
Code"), establishes base building line locations for all public streets within the City of Miami ("City");
and
WHEREAS, in 1985, the City Commission adopted the Southeast Overtown/Park West
Redevelopment Plan that designated Northwest 9th Street between Biscayne Boulevard and Interstate
95 as a mall and the zoned street width was widened to accommodate future development of a mall;
and
WHEREAS, Northeast 9th Street between Northeast 1 st Avenue and Northeast 2nd Avenue is
closed and vacated and incorporated in the Miami Worldcenter District; and
WHEREAS, Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue (East)
was constructed with a 100 foot width and, accordingly, this Amendment will accurately depict the
existing measurement of the 100 foot width; and
WHEREAS, dedication of the full right-of-way has not occurred on Northwest 9th Street between
Northwest 2nd Avenue and Northwest 3rd Avenue and this segment was enhanced with decorative
sidewalks, crosswalks and trees within the original 50 foot wide right-of-way; and
WHEREAS, the "D.A. Dorsey House" located at 250 Northwest 9th Street and the "Ward Rooming
House" located at 249-255 Northwest 9th Street have been designated as Historic Sites by the City's
Historical and Environmental Preservation Board; and
WHEREAS, both the "D.A. Dorsey House" and the "Ward Rooming House" sites extend up to the
original 50 foot right-of-way line, thereby precluding the widening of Northwest 9th Street to the full 80
foot right-of-way width between Northwest 2nd Avenue and Northwest 3rd Avenue; and
WHEREAS, to continue the protection of the existing historic sites and conform with new
development now being realized in the area, a reduction in the zonedstreet width to the original
dedicated street width of Northwest 9th Street between Northwest 2nd Avenue and Interstate 95,
Miami, Florida, is warranted; and

WHEREAS, the City Administration's review of this transportation corridor reveals that the current
developed roadway adequately serves the vehicular transportation and pedestrian needs of the public
and permits the continued protection of the historic buildings; and
WHEREAS, when a street is deleted from the non-standard street widths Code Section, it
automatically reverts, per City Code Section 54-187, to the "default" standard city street width of 50
feet, 25 feet measured from the centerline of the street to the base building line; and
WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of
the modification of the zoned street width of this roadway on their operations and have no substantial
objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54/Article I of the City Code, entitled "Streets and Sidewalks/In General", is
amended in the following particulars;{1}

Sec. 54-190. Nonstandard street widths.
Base Building lines shall be located from the centerline as specified for each of the following streets:

Section 3. If any section, part of a section, paragraph, clause, phrase or word of the Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and adoption
thereof.{2}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
(10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it
shall become effective immediately upon override of the veto by the City Commission.
