The intention of this application is to request per the [h» of Miacni Planning Department's suggestion, made
during the Pre -Application meeting that took place on Monday June 29, 2015 at the City of Miami with regards
to my property, an extension of boundary T4 -L "General Urban Transect Zone Limited" to the subject property
located at 2149 5VV 30th Court, which is currently zoned T3-0. The extension ofboundary would permit
commercial business use ofthe property, asT4-Lwould allow.

Extension of Zone Boundary
Dear Sir or Madam:
We initially ;met with the Zoning Department in order to discuss the mariner in which we could
change the zoning on the above -referenced property to a commercial use, Zoning gave us a
pre -application referral letter dated May 19 2015, suggesting that we seek all extension of the
zone boundary under Article 7,1,2.3 (c:) (1), (Ex. 1, Pre -Application letter, pp. I and 2).
That provision states: „Except where the proposal for the rezoning of property involves an
extension of an existing Transect boundary, no rezoning of lard shall be considered which
involves less than forty thousand (40,000) square feet of land area or two hundred (200) feet of
street frontage on one (1,) street,"
Per this suggestion, we submitted the attached letter dated May 22,; 2015 o the Planning
Department seeking under Article 7.1,2.8 (c) (1) to extend the T5-0 transect zone to the
subject property, 2149 SW 30th Court, which is currently zoned T3-0. (Ex, 2, Property owner's
original letter of intent and pouting Sheet given when Application was dropped off at the
Zoning Dep't on .lune 8, 2015, pp, 1 and 2): The extension would have allowed commercial
business use of the property amid was based can the exception that permits tile rezoning ,of
property where it involves all extension of an existing transect boundary,
The Planning Department issued a letter denying this request, stating that the exception in
Section 7.1.2.8 (c) (1.) does not4apply, (Ex. 3, Hand -delivered tetter from Planning Dept dated
June .25, 2015, pp. 1 ,and 2). After a meeting with members of the Planning Deparin7ent, the
Planning Department suggested that we apply for an extension of the T44 transect zone to
the subject property, 214.9 SW 30th Cour, which is currently zoned T3-0. The extension would
permit limited commercialbusiness use of the property, as T4 -L would allow.
However, the Zoning Department continues to state that the exception in Article 7,1.2:8 (c) (1)
does in fact apply.
We unfortunately have spentsignificant time and money in submitting the initial request to
extend the T5-0 transect zone to the subject property, and per the position of the Zoning
Department, we believe that this re -zoning is appropriate. We therefore request that the
Planning Department approve, the request to re -zone the property to 1"5-0.
However, at the very least, we request that the Planning' Department, per its suggestion made
at the above-referencedr-neeting, agree to the re --zoning of the property frorn 'T3-0 to T4 -L,
Per the Planning >Department's suggestion, during our meeting can Monday June 29, 2015, we
are submitting the attached letter dated July 1, 2015 to apply for an extension of boundary T4 -
L transect zone to the subject property, 2149 SW 30th Court, which is currently zoned T3-0. The
extension of boundary would permit commercial business use of the property, as T4 -L would
allow, (Ex, 4, New Letter of Intent frorn Property Owner and attached Exhibit "A" showing T4 &
T6-8-0 approvals adjacent to T3-0 Zoning Atlas),
Further, due to the tirne that has passed in complying with the differing requests from the
Zoning and the Planning Departments, we respectfully request that the application be
expedited to be submitted for July 17, 2015 review by the Zoning Board,`'

A Pre -application meeting with the Office of Planning was scheduled on Friday, June 12, 2015, however
the applicant did not attend. The applicant request is:
A rezoning Pursuant to Article 7, Section 7.1.2.8 (c) (1), to allow the successional rezoning of
/and. The proposal is to change the zone the subject lot from T3-0 to T5-0; and a Land Use
change from Duplex Residential to Medium Density Restricted Commercial to correspond with
the proposed rezoning.
Based on the request, staff has prepared the following comments. Please note, that said comments are
not to be construed as a recommendation of approval,
1. Pursuant to Article 7, Section 1.1.2.8 (c) 1, the proposed rezoning of the Lot located at 2149 SW
30 Court, frorn T3-0 to T5-0 does not qualify as successional zoning change. The proposal
does not involve the extension of an existing transect boundary; include a minimum of 40,000
square feet of land area or 200 feet of street frontage on one street. As proposed, this is not a
valid Rezone request and may not be submitted for the September 2015 Rezone Cycle.
2. Be advised, that the Planning and Zoning Department reserves the right to make
recommendations pertaining to which Transect Zone will yield the most coherent zoning pattern
in the context of the immediate vicinity,
