A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A REVOCABLE LICENSE
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY
OF MIAMI ("CITY') AND CROCODILE CANTINA, INC. D/B/A MAMBO CAFE
("LICENSEE") FOR DOCKSIDE RESTAURANT SEATING INCLUDING, BUT NOT
LIMITED TO, THE DAILY SET-UP, BREAKDOWN AND MAINTENANCE OF TABLES
AND CHAIRS AS WELL AS THE PROVISION OF FOOD AND BEVERAGE
SERVICES, ON CITY -OWNED PROPERTY LOCATED AT 401 BISCAYNE
BOULEVARD, N215, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN
EXHIBIT "A", ATTACHED AND INCORPORATED.
WHEREAS, the City of Miami ("City") is the owner in fee simple of the property located at 401
Biscayne Boulevard, N215, Miami, Florida, as more particularly described in Exhibit "A" ("Premises");
and
WHEREAS, the Crocodile Cantina, Inc., d/b/a Mambo Cafe ("Licensee"), currently owns and
operates a restaurant at Bayside Marketplace at a location bordering the Premises; and
WHEREAS, the Licensee has inquired about usage of a defined area consisting of approximately
one hundred forty-four (144) square feet of the Premises to expand its seating area for the purpose
of providing dockside restaurant seating; and
WHEREAS, it is the mutual desire of the City and the Licensee that the Licensee use the
Premises temporarily by means of this Revocable License Agreement, which is revocable at -will by
the City and without need for consent from the Licensee; and
WHEREAS, this Revocable License Agreement does not transfer any interest in the Premises,
including any leasehold interest owned by the City, does not confer a right to use the Premises for
any purposes that are not specified herein, and does not convey or transfer any right to exclude the
City from the Premises;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is hereby authorized{1} to execute a Revocable License Agreement,
in substantially the attached form, between the City and the Licensee for dockside restaurant seating
including, but not limited to, the daily set-up, breakdown and maintenance of tables and chairs as well
as the provision of food and beverage services, on City -owned property located at the Premises, as
more particularly described in Exhibit "A", attached and incorporated.

Section 3. This Resolution shall become effective immediately upon adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all regulations that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} This Resolution shall become effective as specified herein unless vetoed by the Mayor with
ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this
Resolution, it shall become effective immediately upon override of the veto by the City
Commission.
