HomeMy WebLinkAboutLegislationFile Number: 15-01581 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-72(B)(16) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FTI TECHNOLOGY, THE ELECTRONIC DISCOVERY PRACTICE OF FTI CONSULTING, INC., FOR RINGTAIL SOFTWARE AS A SERVICE, A COMPUTER ASSISTED LEGAL DISCOVERY SERVICE, FOR THE OFFICE OF THE CITY ATTORNEY, ON A MONTH-TO-MONTH BASIS, WITH A BASIC SERVICE FEE OF $3,450.00 PER MONTH, FOR 300 GIGABYTES OF DATA PER MONTH AND UP TO 25 USERS PER MONTH, FOR A TOTAL AMOUNT NOT TO EXCEED $41,400.00 FOR AN INITIAL TWELVE (12) MONTH PERIOD, WITH OPTIONS TO EXTEND AT A TOTAL AMOUNT NOT TO EXCEED $41,814.00 FOR A SECOND TWELVE (12) MONTH PERIOD AND $42,232.14 FOR ATHIRD TWELVE (12) MONTH PERIOD, FOR ATOTAL CONTRACT AMOUNT NOT TO EXCEED $125,446,14, WITH EACH TWELVE (12) MONTH PERIOD SUBJECT TO SPECIFIED ADDITIONAL CHARGES FOR EXTENSIVE USAGE AND/OR ADDITIONAL SERVICES AS PARTICULARLY DESCRIBED IN THE AGREEMENT. WHEREAS, discovery is a significant portion of the pretrial litigation process, with a growing number of records and communications being maintained, received, and produced electronically; and WHEREAS, the Office of the City Attorney requires a resource by which to thoroughly and efficiently review documents produced and received pursuant to the rules of civil procedure and the Florida Public Records Act; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Pursuant to Section 18-72(B)(16) of the Code of the City of Miami, Florida, as amended, the City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with FTI Technology, the electronic discovery practice of FTI Consulting, Inc. for Ringtail Software as a Service, a computer assisted legal discovery service for the Office of the City Attorney, on a month-to-month basis, with a basic service fee of $3,450.00 per month, for 300 gigabytes of data per month and up to 25 users per month, for a total amount not to exceed $41,400.00 for an initial twelve (12) month period, with options to extend at a total amount not to exceed $41,814.00 for a second twelve (12) month period and $42,232.14 for a third twelve (12) month period, for a total contract amount not to exceed $125,446.14, with each twelve (12) month period subject to specified additional charges for extensive usage and/or additional services as particularly described in the agreement. Section 2.
